Mr. Grusenmeyer said there are trees that could present some difficulty as <br />well if they put a brick wall near the property line. He indicated he would rather not disturb the <br />foliage. There was further discussion about the height and location of the wall. Mr. Grusenmeyer <br />said he would recommend looking at the area in the back because that is where the concentration of <br />light will be. He said the lights would be diffused. Mr. Koeth asked NIr. Maloney if he is opposed to <br />having the brick wall and taking away some of the foliage in the back by his property line. Mr. <br />Maloney indicated he is not opposed to that. He indicated the foliage growth is within his property <br />line and to trim it out of there is no problem. Mr. Maloney said his neighbor, Mr. Zipfel, is quite <br />conc;erned because if you look at where the cars will come in to the lot and make a turn to go west, the <br />lights will hit the homes all the way around. He added that a sports utility vehicle has headlights that <br />are :higher than a normal car. Mr. Hreha indicated he disagreed with the comment about the lights <br />being diffused. Mr. Hreha suggested working with the neighbors on finding a solution. If the foliage <br />is on a resident's property anyway, that is not an issue with Chambers building a wall. Mr. <br />GruSenmeyer said if they build away from the property line it will help save some foliage but then <br />they have area that will be difficult to maintain. Mr. Hreha mentioned when Tops came in to the city <br />to put up a new store, they had already met with neighbors before reaching the Planning Commission. <br />The;y had several meetings and worked out a number of issues ahead of time. He suggested the <br />applicant work with their neighbors to focus on a solution that is good for both sides. Mr. Koeth <br />aslce:d W. Maloney if there is a problem having the wall and having perhaps 2 feet of area that he <br />would have to maintain. W. Rymarczyk pointed out if Mr: Maloney were to sell his property, a new <br />owner may not want to take care of the property by the wall. Mr. Koeth said he believes they will <br />neecl to work along the lot line and if there is a problem with salvaging trees, they may need to give up <br />some trees. Mr. Rymarczyk suggested they keep it more into their property where they can get back <br />thert-I to maintain it. Mr. Koeth pointed out there could be a break somewhere and they can get <br />through to keep up the area. Mr. Grusenmeyer asked for confirmation that they would be allowed to <br />pull the wall off the line 2 feet or so because of concerns that the neighbors have. Mr. Koeth <br />coni:irmed they would be allowed to do that, but he mentioned they would have to maintain that 2 feet <br />on t.he other side of _ the fence. Mr. Grusenmeyer mentioned that they can gather names of the <br />appi-opriate people and set something up so that issues can be addressed. Mr. O'Malley asked if Mr. <br />Koeth is recommending a referral to the Architectural Review Board. Mr. Koeth indicated the <br />Plan.ning Commission would like to see them again but they would recommend they go before the <br />Arcliitectural Review Board. Mr. Spalding asked about the landscaping for the driveway on the <br />western border. Mr. Grusenmeyer referred to the plans and said they will add a number of flowering <br />trees. Mr. Spalding expressed concern about the existing trees being affected by construction. Mr. <br />Gru;3emneyer said the trees are in relatively good shape but they can have the landscaper review them <br />and trim out what needs to be trimmed out. Mr. Spalding suggested having the Forester review the <br />site. <br />Chairman Koeth motioned to have Chambers Funeral Home come back to Planning Commission and <br />made the following recommendations. He indicated the Commission would like them to have lighting <br />with. poles in the back parking lot. They need to come up with a design and photometrics with zero at <br />the ;lot line. They would like the front spaces to be land-banked so they can save the trees, Along <br />with. that they would like to have the proposal go to the Forester to take a look at the landscaping and <br />the trees, and then get his recommendations. They want a brick wall consistent with the brick <br />samples, that would be 6 ft. high that runs through the back of the property, which is the north side. <br />The;y would like the proposal sent on to the police department and traffic department to get feedback <br />froni them. Mr. Rymarczyk asked for clarification on the height of the wall. Mr. Koeth indicated they <br />would take it from the parking lot grade. Mr. Grusenmeyer asked if they want all the area in front <br />8
