is a nf;ed and Mr. Schmidt has proved himself successful. Many people in the community have <br />benefit:ed from the facility. It makes sense to use it for promotional facilities. Mr. Schmidt would <br />like to get going on it and he believes it will be beneficial for the City. Mr. Spalding asked how far <br />the board could extend the zoning. He said rather than just rezone Mr. Schmidt's property, it might <br />make sense to go back to the high line. Mr. Gareau said when you look at the layout, it would <br />probably make sense to go from the county line back to the entrance to the industrial park. He <br />pointed out that the lot on the corner of the industrial park is only an acre and nothing would be put <br />there. People from the insurance building and other people in the area have spoken in favor of <br />having their property rezoned. Mr. Gareau said it is a short segment of land and people have been <br />trying to sell it for years. It would be ideal if one of the lots in there could fit a hotel or motel. There <br />would be a lot of money from the hoteUmotel tax.., Mr. Spalding said he was thinking if they just <br />rezone:d Mr. Schmidt's parcel as a special use again, it would be spot zoning. Mr. Gareau said he <br />does not believe it would be spot zoning. Mr. Spalding brought up Fuzzy's Tavern and said it is not <br />included in their proposal. It should be included in the total picture. Mr. Schmidt said he believes <br />the Fuazy property is partially in North Olmsted and part is in North Ridgeville. Mr. O'Malley said if <br />they are looking for a way to draw the line for the zone that expands it beyond the applicant's <br />borders and toward the industrial zone, it makes some sense to take it all the way to the entrance of <br />the industrial zone. He would interpret the master plan as drawing a line shy of that entrance way. <br />The master plan has identified on its maps a Parcel #7 that encircles the industrial park. The master <br />plan i2idicates that parcel should remain industrially zoned. It includes a lot that is west of the <br />roadway that enters the industrial zone. There is a block of land that is larger than just this <br />applicant's property that would include everything to the Lorain County line, and up approaching <br />that er?trance to the industrial park. It is map 8-6 of the master plan. It is a map of undeveloped <br />areas for the final development plan and on this side of Lorain Road, it might be the second last map <br />in the packet. Mr. O'Malley suggested using map 7-62 to try to match it up. Mr. Gareau asked if <br />they wait for the City to go through the process to catch up with Mr. Schmidt, or do they make Mr. <br />Schmidt wait to catch up with the City. The City had previously approved his proposal by giving a <br />use variance twice. The facility is there and he wants to expand it. Mr. Spalding asked about a use <br />varianoe for the fourth field while they are working on the rezoning. Mr. Crareau indicated the lender <br />will not go along with it. When you get that big, you really are defeating the purpose of a use <br />variance. Mr. Koeth asked if they could make two motions. They could approve his complex under <br />Motorist Service District and then make recommendations to expand that zone out to the industrial <br />park. Mr. Gareau asked if it would be submitted to City Council at the same time and then they <br />-would deterniine if that is appropriate., ' Mr. Koeth iridicated he has spoken to 'a couple of <br />Councilmen and they_ are not opposed to making Mr: Schmidt's property Motorist Service. They <br />want r.nore discussion on the rest of that area. Mr. Gareau said it makes a lot of sense. He does not <br />think it would be right for him to come in and ask to have someone's property rezoned to something <br />they do not want. As a planning body, it makes sense however. Mr. Spalding indicated his concern <br />is if you have Motorist Service on one side of Lorain Road, you should have it on the other.. Mr. <br />Gareaix said what happens when you make a little bit of progress is it will get the ball rolling. That <br />area has not progressed at all and probably won't. If they act on the south side of Lorain Rd. and - <br />make a recommendation to Council, then Council will perhaps look at the entire area to see what can <br />be dorie. There is a depth limitation on the south side. The highway is there. Mr. O'Malley said <br />there are two ordinances. One is to rezone this parcel, and the other is to redefine the permitted uses <br />in Motorist Service. They seem as though they would naturally go together; but they don't <br />necessarily have to. They can go ahead with looking at the definitions of the permitted uses in <br />Motorist Service and proceed on that basis. And at the same time, they can study the rezoning issue <br />separately. He said, as he reads it, under 1127 of the code, when a request for rezoning is made to <br />the Planning Commission and the Planning Commission initiates the proposal for rezoning, it goes <br />k <br />8
