r B will be located in the southern portion of the existing parcel in the Retail Business, General zone and <br />the C Residence, Single zone. <br />Mr. Koeth reviewed that Mr. O'Malley indicated that a representative from Romp Reality indicated that <br />Mr. Conway sent them a letter indicating they would not be allowed on the agenda. The board received <br />a Memo from Mr. Conway suggesting there are State and Local building violations which this site will <br />be in violation of if this lot split takes place. Mr. Koeth questioned if the applicants had received a copy <br />of Mr. Conway's memo. The clerk indicated she did not know if the applicants had viewed Mr. <br />Conway's memo. Mr. Koeth indicated that he wanted to make sure the applicant is fully aware of what <br />issues will arise from their request. Mr. O'Malley reviewed that this proposal went against the normal <br />process of a request. The norm is for Planning Commission to deal with lot splits, which have no <br />buildings. This developer is requesting to be allowed to create variances and does not view their request <br />as a problem. Mr. Koeth questioned what the applicants really want to do with the lots. Mr. O'Malley <br />indicated that a developer by the name of Terra Group has shown an interest in purchasing the Drug <br />Mart portion of the lot from Mr. Romp. However they have not disclosed whether they will be <br />demolishing the buildings or not. Mr. Deichmann indicated that he wanted to make it clear for the <br />record that the applicants are creating the zoning problems. The applicants are also creating State <br />Building Code violations by requesting the City allow the lot split. Mr. O'Malley indicated that North <br />Olmsted's Board of Zoning Appeals could not address the State Building Code violations. The Board of <br />Zoning Appeals would have to grant things contingent upon the State granting variances for their <br />violations. Mr. Lasko indicted that he could not fathom allowing something like this, which would <br />create so many problems. Mr. Hreha suggested that there is enough concern that the Building <br />Commissioner should send a copy of his memo to the applicant. <br />R. Koeth indicated that Romp Realty Lot Split PP# 237-01-001,007, 007 is tabled until meeting next. <br />COMMUNICATIONS: <br />Mr. Koeth asked for clarification on the memo that was sent to Council on their behalf reaarding funds <br />for a Professional Planner. Mr. O'Malley suggested that Councilman McKay informed him that money <br />had been placed among the Mayors line items for a Professional Planner. He spoke to the Mayor who <br />suggested that he would be contacting a planner to look at the issue of rezoning parcel-E. Mr. Koeth <br />indicated the main issue is Parcel -E but the board could request he/she also look at the rezoning of the <br />west side. Mr. Koeth suggested that the board would like the law department's help in getting the <br />rezoning issue settled. The board would like to invite the planner to come before the Planning <br />Commission. Mr. Hreha suggested having the planner look at the West Side as well as parcel-E.
