also showed them a vinyl fencing that was very solid. He said he thinks it would serve the purpose for <br />the residents even better than what he is suggesting with board on board because the construction <br />materials would last many years longer. Mrs. O'Rourke said it would sound proof as well. Mr. Hreha <br />told Mr. McKay he would really need to see what they have and he would be happy with it. Mr. <br />Emling showed Mr. McKay a sample of the fencing. Mr. McKay said it was fine and he will look at <br />the landscaping plan to make sure there are trees on the mound. Mr. Koeth said that Mr. Emling has <br />the landscaping plan with him if he would like to look it over. Mr. 1'aul Miller, Councilman At Large, <br />concurs with Mr. McKay's concerns about the height of the mounding and the fence. The buses are <br />getting bigger and they are concerned about exhaust fumes. Residents are exactly down wind from the <br />buses and they want to make sure that issue is addressed through the mounding. It was been about 2 <br />years since they had a meeting at Town Hall with RTA. An RTA representative presented an opinion <br />that when a facility like this goes into a neighborhood, the property values actually increased. Mr. <br />Miller said he was stunned by this. He asked for a copy of the report that supported that statement and <br />he was assured that he would get that report. At another meeting about 6 months later, he asked for the <br />report again. He never received it, even though he was assured by someone at RTA that he would get a <br />copy. He remains doubtful of any supporting numbers for that. He said on the issue of vending <br />machines, he is not clear. The numbers and types of printed media in various machines are an issue. <br />Mr. Miller was assured by the board that there will be no vending machines. Mr. Tom Terbrack, <br />General Manager of NOlVIBL, said they currently sell the Plain Dealer but there will be no vending <br />machines at the I'ark-N-Ride. He indicated they are not permitted on RTA property. Mr. Koeth said <br />they were concerned about vending machines that offered refreshments. Fie said the board <br />recommended no vending machines to RTA and it was taken out of their plan. Mr. Miller said his <br />concern was printed media where there are apartment guides and tabloids, and other types of <br />newspaper boxes. He wants to be sure they don't have that kind of unsightly stuff because it ends up in <br />neighbors backyards. Mr. Nick Weber of Kennedy Ridge asked Mr. Joyce to comment on the pros and <br />cons of having a 24 hour, 360 dearee surveillance camera mounted on the roof of the station building <br />for security purposes. Mr. Jerry Bosl came forward a second time to comment on what Mr. McKay <br />had said regarding the height of the fence and mound. He would like to support the 15' fence whether <br />it's a 9' mound and a 6' fence on top, although he thinks a higher fence and a smaller rnound would <br />actually be more secure. It is tougher to get over a fence than it is to crawl up a mound. He supports <br />the fence proposed by Mr. McKay. He said since the buses are around 12', and with exhaust blowing <br />around, the more it can be contained the better off they are. He said that goes for the lighting too. Mr. <br />Walt Sheffield, the presiding elder of the North Olmsted Friends Church, caine forward. His first <br />question was directed to the Assistant Law Director. He asked when is the city, or does the city, have <br />any obligation to notify his church that they are in the process of taking his property. He understands <br />the first reading has already been done. Mr. O'Malley said his understanding is that prior to the city <br />passing a resolution of necessity to take the property, there were some negotiations on behalf of RTA <br />to acquire this property. As far as the actual filing of the action, the date has yet to be determined. The <br />city is discussing now an agreement with RTA concerning the use of the eminent domain power of the <br />city, and actually following through on the Council's resolution of necessity. It is his understanding <br />that the property owners would have been contacted by the RTA to negotiate a taking of the property <br />without court proceedings some months prior to the Council's action. It would certainly be appropriate <br />for the Law Director, after the agreement is passed, to again contact the property owners before filing <br />the action in court. Mr. O'Malley indicated that after the agreement is passed by Council, the city law <br />department that is pursuing this acquisition on behalf of the RTA, would likely call and write the <br />property owners before an action is filed in court. Mr. Sheffield said it would seem if there would be <br />readings before City Council, that would be the time for people to listen to a proposal and put their two <br />cents in. Mr. O'Malley said the matter before Council at the present time is an agreement between the <br />city and the RTA as to RTA reimbursing the city, paying for the cost of improvements, paying for the <br />land being acquired, things of that nature. Mr. Sheffield said that from a personal standpoint if <br />someone said to him that the Council had met to discuss taking his property without ever notifying <br />10
