. <br />CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIEFERENCE" <br />5PECIAL BOARD OF BUILDING CODE APPEALS <br />MINUTES - NOVEMBER 14, 2002 <br />IN COUNCIL CHAMBERS <br />3:00 P.M. <br />ROLL CALL: <br />Chairman Puzzittiello called the meeting to order at 3:00 p.m. <br />PRESENT: Chairman R. Puzzitiello, Board members; R. Klesta, M. Conway, P. Engoglia and N. <br />Althen. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Safety Director, R. 7esse, Building <br />Commissioner, D. Conway and Clerk of Commissions D. Rote. <br />II. REVIEW AND CORRECTION Oy MINUTES: <br />The minutes of the October 17, 2002 Board of Building Code Appeals meetings have been <br />submitted for approval. <br />P. Engoglia motioned to approve the October 17, 2002 Board of Building Code of Appeals <br />minutes as submitted. M. Conway seconded the motion, which was unanimously approved. <br />III. BUII,DING DEPARTMENT REQUESTS: <br />1. Ann Donovan; 5832 Elmhust Drive; <br />Proposal is to hear an appeal by the property owner from an Order issued by the Building <br />Commissioner dated November 4, 2002. Which declared the premises to be a public nuisance and <br />ordered the property to be vacated, all pursuant to various sections of North Olmsted Chapter 1331. <br />Chairman Puzzitiello called all interested parties forward to review the request. Mr. Puzzitiello <br />questioned if Mrs. Donovan had representation to speak for her. Mrs. Donavan indicated that she <br />would represent hersel£ Mr. O'Malley advised the commissioners how to proceed. Mr. <br />Puzzitiello asked Mr. Conway to review what took place. <br />Building Commissioners Report: Mr. Conway reviewed that October 31, 2002, the North <br />Olmsted Fire Department was called out to 5832 Elmhurst to aid an elderly resident who may have <br />fallen and that the Police assist the Firemen. Mrs. Donavan was transported to the hospital and the <br />animal warden was called in to remove several animals from the home. Based on the report and <br />photos from the Police department the County Health Department as well as the Building <br />Department entered the home to determine the condition of the site. Chris Bosworth with the <br />Health Department and two Building Inspectors confirmed his belief that the building was unsafe to <br />occupy due to the unsanitary conditions. The structure was then secured and posted as such. On <br />November 4, 2002, an order to vacate the premises was sent to Mrs. Donovan until it is returned to <br />a sanitary condition. On November 7, 2002, my office received a letter from Mrs. Donovan <br />requesting a hearing, which brings us to today's meeting. Mr. Conway indicated that he is asking <br />the board to confirm his findings that the structure is unsafe to occupy and that it should remain <br />vacated until it is returned to an occupy-able condition. The board has been provided a copy of the <br />reports from the Police, Health, and Building Departments as well as pictures, which should give <br />the board members a good idea of what is going on.
