in order to work with Planning Commission & the City they have moved the antenna, which has <br />now caused them to require variances. The Building Department has no objections to the <br />variance's being sought. The applicant will be improving the site, which is not an easy thing to <br />do. An audience member came forward to review the plans. No further comments were made. <br />J. Maloney motions to grant Cingular Wireless (CEn Povver Tower of 31133 Lorain Road <br />their request for variance (1123012), which consists of a wireless communication tower <br />located on a CEI pole and that the following variances are grantecl as amended: <br />1. A 67 foot variance for front yard setback, (code requires 75', applieant shows 8'), <br />section (1139.07). <br />2. A variance for not having an irrigation system, (code requires the system, applicant <br />shows "None"), section (1139.14). <br />3. A 2571 foot variance for being within lh mile of another tower, (code requires 2640', <br />applicant shows 49'), section (1151.05 (A)). <br />Which is in violation of Ord. 90-125 sections (1139.07), (1139.14), and (1151.05 (A)). <br />Planning Commissions recommendatnons are to be included, 6-foot arborvitae to go around <br />the entire fenced area. J. Konold seconded the motion, which was unanimously approved. <br />Variances Granted. The clerk gave the applicant a copy of the memo from Planning <br />Commission sending them to Board of Zoning and Development meeting Tuesday, November <br />11, 2003 at 8:00 p.m. <br />5). Berst Carwash 4700 Clalzue Road: WRD 4 <br />Request for variance (1123.12). Proposal consists of a carwash in a multi-family district. <br />The following variance is requested: <br />1. A Use Variance to allow a carwash facility in a multi-family zoning. <br />Which is in violation of Ord. 90-125 section (1137.02). Note: #1. The City Engineer requires <br />owner to consolidate the parcels. #2. Applicants tabled themselves on 6/24/03 and Planning <br />Commission recoinmended the request for a use variance be denied on 9/09/03. <br />Applicaa?ts requested their request lbe tabled until the next meeting. See further discussion <br />of this request under communications. <br />IV. COMMUNICATIONS: <br />A Mr. MacDonlld came forward from the audience and indicated that Building Inspector <br />Hovancsek informed him that he was on the Board of Zoning Appeals docket for his addition to <br />his home. Mr. Conway indicated that he would look into the matter. 1VIrs. Rote indicated that <br />she had no files for the request and no legal notices were released therefore, the board members <br />could not address the matter. 1VIr. Conway asked for Mr. MacDonald's contact information and <br />assured him that he would contact him the next day. Mr. Maloney apologized for the confusion <br />and reiterated that the board could not address any of Mr. MacDonald's issues. However, the <br />issue would be placed on the Board's December docket and the Building Commissioner would <br />contact him regarding the matter as soon as possible. <br />Mr. O'Malley indicated that the board members inight have noticed the attention that has been <br />given to Parcel-E in the local papers. He is anticipating that the Parcel-E proposal will be <br />coming before the Board of Zoning Appeals on their December 4th docket. The issues that the <br />Board members will be addressing could be rather involved. He had hoped that the Berg <br />Carwash request could have been resolved at tonight's meeting. Unfortunately, current codes <br />allow applicants to withdraw themselves from a meeting at a moment's notice. For the Board <br />5
