her the application was for a screened in porch. Mr. Kremzar asked if there is any way of verifying what the <br />inspector told them. Mr. Rymarczyk said he believes the inspector told them that they should have <br />indicated it is a three-season room, which they did not. He said the inspector was out there after the permit <br />was issued. Mrs. Sergi said she visited the site and viewed the inside and outside of the addition. The <br />addition is not visible from the road. It is a beautiful addition. If they had a screened in porch, she thinks <br />the neighbor would have been just as unhappy. Ms. Connelly said she is not sure a screened in porch would <br />have been permitted either. Mrs. Sergi said she does not think Mr. Legarth should be penalized for what <br />could have been or what should have been. <br />N. Sergi made a motion to grant Dominic Legarth, 24170 Beech Lane, the request for variance which <br />consists of an add'ation to the house and that the following variances be granted: <br />A special permit to add to a non-conforming building (1165.02). <br />l. A 6 foot variance for side yard requirements (minimum widths) (code requires 15 ft., applicant show 9 <br />ft.), section (1135.07 (a)). <br />2. A 1 foot variance for side yard (code requires 5 ft., applicant shows 4 ft.), section (1135.07 (a)). <br />3. A 6 foot variance for distance between adjacent dwellings (code requires 15 ft., applicant shows 9 ft.), <br />section (1137.07 (a)). <br />Which is in violation of Ord. 90-125 sections (1135.07 (a)), (1137.07 (a)), and (1165.02). <br />NOTE: Due to a Building d)epartnzent error, a permit was issued <br />The motion was seconded by J. Konold. Roll call on the motion: J. Konold, N. Sergi, and <br />J. Maloney - Yes, W. Kremzar, T. Kelly - No. VARIANCES GRANTED. <br />Mr. Maloney informed the applicant to work with the building department to ensure drainage is in line. <br />3. Dou2 Ford, 5415 Kennedv Ridge, W1tD 4 <br />Request for variance (1123.12). The proposal consists of a detached garage for new home. <br />The following variance is requested: <br />1. A 370 square foot variance for garage exceeding maximum square footage allowed (code permits 750 <br />sq. ft., applicant shows 1120 sq. ft.) <br />Which is in violation of Ord. 90-125 sections (1135.02 (c)(1)). <br />NOTE: Garage araust be built in conjunction with the construction of the new home. <br />Chairman Maloney called all interested parties forward to be sworn in and review the request. Mr. Ford <br />came forward and explained to the board that he is building a new house. He said they completed a lot split <br />a few years ago and are ready to build. He reviewed a larger site plan with the board members. He <br />indicated they would like a detached garage that would be 28x40, making it 370 square feet over what code <br />allows. He said the size of the lot is an acre and three-quarters so it would accommodate the structure. He <br />pointed out on the plan the existing sheds that will be removed. He indicated he does some woodworking in <br />the winter and he would like to have a little shop to build furniture. Mr. Kremzar asked who owns the <br />trailer that is back there by the lot. Mr. Ford said it belongs to some neighbors and it is not on his property. <br />He added that the neighbors all get along. Mr. Maloney asked about the time frame for taking down the <br />existing sheds. Mr. Konold asked if sixty days would be enough time. Mr. Ford said they are about a <br />month away froin breaking ground. Mr. Rymarczyk asked how soon the home will be built. Mr. Ford said <br />the garage and home will be built at the same time. Mr. Rymarczyk asked if the garage will be used for his <br />hobby and not be used to run a business. Mr. Ford confirmed it will not be a business. <br />W. Kremzar made a motion to grant Doug Ford, 5415 Kennedy Ridge, the request for variance which <br />consists of a detached garage for new home and that the following variance be granted as amended: <br />1. A 370 square foot variance for garage exceeding mlximum square footage allowed (code permits <br />750 sq. ft., applicant shows 1120 sq. ft.) <br />Which is in violation of Ord. 90-125 sections (1135.02 (c)(1)). <br />NOTE: Garage must be built in conjunction with the construction of the new home.
