An 11 square foot varianee for sign face area (code permits 26 sq. ft., applicant shovas 37-sq. ft.). <br />Whieh as in violation of Ord. 90-125 seetion (1163.24 (b)). J. Konold seconded the motion, which <br />was unanimorasly approved. Variance Granted <br />IV. COMMCTIVICATIONS: <br />Memo to Office of Commissions and Building Commissioner Dave Conway from Chairman John <br />Maloney regarding applications submitted to the Board of Zoning Appeals <br />Mr. Maloney reviewed that each member received a copy of the letter sent to the Building Department. <br />These questions have come up in the past and we would like to discuss the suggestions. The items <br />being requested are needed to properly address requests. 1VIre Konold ab ees with everything that is on <br />the list and the applicants need to make up their mind as to what they want before they come before the <br />board. 1VIr. Maloney commented that owners of the property must be present at the meetings as <br />contractors can not make final decisions for the homeowners. IVir. Konold commended Mr. Maloney <br />for addressing the issues listed. 1V)tr. Rymarczyk suggested that Mr. Conway would be researching <br />each of the requests and would- get baek to the board with.their findings.__ T_he average homeowner is not <br />capable of knowing how to provide everything required. Mr. 1Vlaloney felt that homeowners should <br />know if they have utility easements on their land or not. 1mVIr. Dubelko suggested that it is important <br />that the Building Department and the Boards & Commissions work well together to make sure the board <br />has everything the board needs to fulfill their duties. He understands that there may be some difficulty <br />in residential applications in way of gettina the information being requested. In the end, if the building <br />department and the coinmission can not work out what is to be provided City Council can address the <br />requireinents by legislation. Board of Zoning Appeals has specific powers and can regulate what is <br />required and the Building Department has an obligation to provide certain material to the board so they <br />can perform their duties. Therefore, the Commission and the Building Department should work <br />together, if this board realistically requires specific items to do their job then the Building Department <br />should do everything they can under their authority to require applicants provide the information. Mr. <br />Ibyixaarczyk again indicated that the Building Commissioner would be researching what the board is <br />requesting over the next few months. Ma•. Dubelko voiced that the Board does have rule making <br />authority of their own, which can require applicants to produce things. However, it is better to first go <br />through the Building Department. Note: Memo to Building Department is attached to these minutes. <br />V.
