Which is in violation of Ord. 90-125, sections (1139.14), (1163.27 (a)), (1163.27 (c)), (1163.24 (b)), <br />and (1161.12 (e)). <br />Chairman Maloney called all interested parties forward to review their request. Mr. Greenberger, the <br />architect came forward to review the request. The applicant passed out color packets and reviewed <br />each variance request and voiced why he thought each one was needed. They only want to irrigate the <br />landscaped area being added. The building will have a four-face fagade although the entrance will <br />face Brookpark Road. The second sign requested will cover the traffic within the mall. The new pole <br />lights will be 30-feet high and will replace the existing 60-feet light poles. The Photometric plans <br />show the light levels meet the current codes. The clerk questioned if the applicants used light plans # <br />2 as requested by the Planning Commission. The applicant indicated plan #2 was used. <br />J. Maloney motioned to grant Jared the Galleria of Jewelry; PP# 235-28-003 Great Northern <br />Mall their request for variance (1123.12), which consists of a new retail store and that the <br />following variances are granted: <br />1. A variance for total landscaped area in lease not to be irrigated (code requires all, applicant <br />shows part), section (1139.14) <br />2. A variance for second wall sign (code permits 1, applicant shows 2), section (1163.27 (a)). <br />3. A 9 inch height variance for signage (code permits 4 ft., applicant shows 4 ft. 9 inches), <br />section (1163.27 (c)). <br />4. A 75.12 square foot variance for maximum sign face area for a building (code permits 103 sq. <br />ft., applicant shows 178.12 sq. ft.), section (1163.24 (b)). <br />5. A 175 foot variance for distance of pole to north property line (code requires 180 ft., <br />applicant shows 5 ft.), section (1161.12 (e)). <br />6. A 165 foot variance for distance of pole to west property line (code requires 180 ft., applicant <br />shows 15 ft.), section (1161.12 (e)). <br />Which is in violation of Ord. 90-125, sections (1139.14), (1163.27 (a)), (1163.27 (c)), (1163.24 (b)), <br />and (1161.12 (e)). W. Kremzar seconded the motion, which was unanimously approved. <br />Variances Granted The clerk advised the applicant that he would go to Architectural Review Board <br />on June 18, 2003 then return to Planning Commission on June 24, 2003. <br />13). Remington College, 26350 Great Northern Shopuin$ Center, WRD 4 <br />Request for variance (1123.12). The proposal consists of parking lot lighting. <br />The following variance is requested: <br />1. A variance to leave existing parking lot lighting. <br />Which is in violation of Ord. 90-125 section (1161.12). <br />Chairman Maloney called all interested parties forward to review their request. Mr. Strelau the <br />architect came forward to be sworn in and address the request. The applicant reviewed that the <br />building will house a 2-year technical school. The only work that will be done to the exterior of the <br />building will be a new fagade for the entrance and landscaping area facing Brookpark Road. There <br />was a lengthy discussion regarding the lighting and whether or not the city code could in fact be <br />followed as well as whether the applicants should have been grandfathered. The applicant suggested <br />he met with the Law Director to discuss his thoughts of the Cities zoning code and offered his office <br />electrical engineer to assist the city in improving the way the code is written. The Law Department <br />advised the board to table the issue so that the applicant could bring forth their expert and the Law <br />Department and Building Department could review the issue. <br />W.
