1. A 7.5 foot variance for set back requirements (code requires 50 ft., applicant shows 42.5 ft.) <br />Which is in violation of Ord. 90-125 section (1135.06 (a)). <br />Chairman Maloney called all interested parties forward to review their request. Mr. & Mrs. Bibbs the <br />owner's came forward to be sworn in and address the request. The applicants want to replace the <br />existing porch, which is falling apart. They would like the porch to be 8-feet out and 24-feet wide. <br />Short discussion regarding the drains around the foundation being replaced took place. <br />J. Konold motioned to grant Arthur Bibbs of 23472 Westchester his request for variance <br />(1123.12), which consists of a new front porch and that the following variance is granted: <br />A 7.5-foot variance for set back requirements (code requires 50 ft., applicant shows 42.5 ft.), <br />which is in violation of Ord. 90-125 section (1135.06 (a)). W. Kremzar seconded the motion, <br />which was unanimously approved Variance Granted. <br />11). Wal Mart Department Store No 2316, 24801 Brookpark Road, WRD 4 <br />Request for variance (1123.12). The proposal consists of six (6) 4'x8'x8' storage container parking <br />spaces. The following variance is requested: <br />1. A variance for 12 car parking spaces, (code does not allow). <br />Which is in violation of Ord. 90-125 section (1161.05 (w)). <br />Chairman Maloney called all interested parties forward to review their request. Mr. Franz, the store <br />manager came forward to be sworn in and address the request. The applicant reviewed that Wal Mart <br />was granted a variance to have 6-trailers on the rear of the lot until July 8, 2003. The trailers and <br />landscaping materials are not taking up parking spaces as they are on a cement slab. The building <br />commissioner explained that while the trailers were not on the parking spaces, they were blocking <br />access to required parking spaces. The law department advised that if the board granted the request <br />they place the same time limitation on the variance, as did the Board of Building Code of Appeals <br />which was 7uly 8, 2003. <br />J. Maloney motioned to grant Wal Mart Department Store No 2316 of 24801 Brookpark Road <br />their request for variance (1123.12), which consists of six (6) 4'x8'x8' storage container parking <br />spaces and that the following variance is granted: A variance for 12 car parking spaces, (code <br />does not allow), which is in violation of Ord. 90-125 section (1161.05 (w)). The location of the <br />storage containers is specified by the Board of Building Code of Appeals meeting dated May 15, <br />2003, with a deadline of July 8, 2003. W. The proposal consists of a new retail store. <br />The following variances are requested: <br />l. A variance for total landscaped area in lease not to be irrigated (code requires all, applicant shows <br />part), section (113 9.14) <br />2. A variance for second wall sign (code permits 1, applicant shows 2), section (1163.27 (a)). <br />3. A 9 inch height variance for signage (code permits 4 ft., applicant shows 4 ft. 9 inches), section <br />(1163.27 (c)). <br />4. A 75.12 square foot variance for maximum sign face area for a building (code permits 103 sq. ft., <br />applicant shows 178.12 sq. ft.), section (1163,24 (b)). <br />5. A 175 foot variance for distance of pole to north property line (code requires 180 ft., applicant <br />shows 5 ft.), section (1161.12 (e)). <br />6. A 165 foot variance for distance of pole to west property line (code requires 180 ft., applicant <br />shows 15 ft.), section (1161.12 (e)). <br />5
