Maloney made a motion to grant David & Karen Bir, 27868 Southern Ave., their request for variances, which consists of 4' and 5' board on board fence and that the following variances be granted as amended: l. A 13.4 foot variance for 68 feet plus/minus of 4' board on board fence in front yard, (code requires 18.4', applicant amended to 5'), section (1135.02 (fl(2)). 2. A variance for 68 feet plus/minus of 4' board on board fence, (code requires 50% open, applicant shows 0%), section (1135.02 (f)(1)). 3. An 18 inch height variance for 68 feet plus/minus of 4' board on board fence, (code requires 30" height, applicant shows 48" height, section (1135.02 (f)(1)). 4. An 8 foot variance for 8 feet of 5 foot board on board fence, (code requires 18.4', applicant shows 12.4', section (1135.02 (fl(2)). 5. An 8 foot variance for 8 feet of 5 foot board on board fence, (code requires 50% open, applicant shows 0%), section (1135.02 (fl(1)). 6. A 30 inch height variance for 6 feet of 5 foot board on board fence, (code requires 30" ht., applicant shows 60" ht., section (1135.02 (f)(1)). Note: The fence from the gate to the sidewalk area will be angled at a distance of 5 feet from the corner of the flowerbed. Which is in violation of Ord. 90-125 sections (1135.02 (f) (1)) and (1135.02 (fl (2)). The motion was seconded by W. Kremzar and unanimously approved. Variances Granted as Amended. Mr. Bir asked if he would have to go for another variance to replace the back part of the fence. Mr. Rymarczyk said they would have to apply to the Board of Building Code of Appeals to put up another fence. 8). Mark Sanders. 24138 Elm Road WRD 4 Request for variance (1123.12). The proposal consists of installing a swimming pool in backyard. The following variance is requested: 1. A 178 square foot variance for exceeding rear yard coverage for accessory structures, (code permits 1170 sq. ft., applicant shows 1348 sq. ft.). Which is in violation of Ord. 90-125 section (1135.02 (d)(2)). Chairman Maloney called all interested parties forward. Mr. Sanders came forward to be sworn in and address the request. Mr. Sanders showed the board members pictures of his yard. He pointed out the pool would go behind the garage and it would leave him plenty of room. He is off the property lines by 10 feet. Mrs. Sergi said the way the drawing is done you can't really tell how the pool will fit. She said the photos give a better idea of where the pool will go and you will not be able to see it from the road. She added that there is enough room offthe side lots. N. The proposal consists of Erecting a temporary 40'x60' tent from 7une 2, 2003 to June 9, 2003 and from September 8, 2003 to September 15, 2003. The following variance is requested: 1. A variance for a 15 car parking reduction. Which is in violation of Ord. 90-125 section (1161.05 (w)). 6
