The reason <br />the shed requires a 5-foot variance is that one side of the yard has a drain were the shed would <br />need to be placed so they felt the best place would be between two existing trees. <br />W. Kremzar motioned to grant John 8z Christine Hoffa of 30000 Westminster Drive their <br />request for variance (1123.12) which consists of a new accessory building (shed) and that <br />the following variance is granted: 1. A 5 foot variance for shed placement from rear <br />property line (code requires 10 ft. applicant shows 5 ft.). Which is in violation of Ord. 90- <br />125 section (1135.02 (d)(4)). J. Konold seconded the motion, which was unanimously <br />approved. Variance Granted <br />3. Ravmond Chervenak, 4695 Martin Drive, Ward L• <br />Request for variance (1123.12). The proposal consists of a garage roof. <br />The following variances are requested: <br />1. A 1.5 foot variance for private detached garage height (code permits 15 ft., applicant shows <br />16.5 ft.), section (1135.02 (c)(1)). <br />2. An 8 inch variance for private detached garage location (side p/1) (code requires 5 ft., <br />applicant shows 4 ft. 4 inches), section (1135.02 (c)(2)). <br />Which is in violation of Ord. 90-125 sections (1135.02 (c)(1)), and (1135.02 (c)(2)). <br />Chairman Maloney called all interested parties forward to review their request. Mr. <br />Chervenak the owner and Mr. Gibel, the neighbor each came forward to be sworn in and <br />address the request. Mr. Chervenak would like to have a variance for extra room and a better <br />pitch that would keep the leaves from the neighbor's tree out of the gutters. He would like to <br />use the existing slab from the garage he is replacing. Mr. Kremzar questioned if the slab was in <br />good shape. Mr. Chervenak voiced that the slab was usable. Mr. Maloney questioned if the <br />neighbor had any comments. Mr. Gibel indicated that he was for the work Mr. Chervenak was <br />doing and felt it would be an improvement. No further comments were made. <br />T. A 25 foot variance for side yard fence on corner lot (code permits 0, applicant shows 25 ft.). <br />Which is in violation of Ord. 90-125 section (1135.02 (f)(2)). <br />Chairman Maloney called all interested parties forward to review their request. Mr. and Mrs. <br />Kistemaker the owners and children Megan and Ryan came forward to be sworn in and <br />address the request. Mr. Kistemaker reviewed that they would lose a lot of yard if the fence is <br />constructed to code. Their neighbors have voiced that they do not have any objections to the <br />fence. They would also like the fence for the safety of their children. Mr. Kremzar indicated <br />that he noticed that there were no other fences in the neighborhood. He also questioned how the <br />swells in the ground would be addressed. Mr. Kistemaker indicated that the builder would <br />build the fence on site to make sure the swells are properly addressed.
