Mrs. Sergi questioned if the applicant would be willing to move the fence in a little. <br />Mr. Kistemaker suggested that if they have to they would bring in the fence some. Mr. <br />Rymarczyk suggested that for safety reasons the fence should be moved inward 4 to 5 feet. <br />Mrs. Sergi suggested that the fence should line-up with the existing bushes. Mr. Maloney <br />voiced that the board is concerned for the safety of children on bikes and requested the fence be <br />moved in 5-feet off the sidewalk. Mr. Kistemaker indicated that he would be willing to place <br />the fence 5-feet in from sidewalk. Mr. Maloney indicated that the rear fence is shown 5-feet <br />off the rear property line and questioned if the fence would be placed within the swell. Mr. <br />Rymarczyk indicated that the drawing is showing the fence 5-feet in from rear yard line. <br />Discussion regarding the drawing submitted by the contractor and what the owner wants took <br />place. The owner indicated that he would place the fence 5-feet in from sidewalk and 5-feet off <br />the rear property line as shown in the drawing. , <br />J. Maloney Motion to grant Ronald Kistemaker of 23234 Woodview Drive this request for <br />variance (1123.12) as amended and agreed which consists of a fence and that the following <br />variance is granted: 1. A 21 foot variance for side yard fence on corner lot (code permits <br />0, applicant shows 21 ft.). Which is in violation of Ord. 90-125 section (1135.02 (f)(2)). <br />The applicant's builder/contractor is to meet with the building department prior to work <br />starting for clarification regarding rear fence placement and swells. W. Kremzar <br />seconded the motion, which was unanimously approved. Variance Granted. <br />5. Dominic Ruccella, 6691 Stearns Road, Ward 3: <br />Request for variance (1123.12). The proposal consists of a lot split creating a lot narrower than <br />required by the zoning code. <br />The following variance is requested: <br />1. An 8.83 foot variance for lot width (code requires 70 ft., applicant shows 61.17 ft.), Which is <br />in violation of Ord. 90-125 section (1135.05). <br />Note: The Planning Commission referred this matter to the Board of Zoning Appeals on <br />March 25, 2003 <br />Chairman Maloney called all interested parties forward to review their request. Mrs. Levoy <br />the applicant's neighbor came forward to review the proposal. After a reasonable amount of <br />time, the Chairman announced that the board would move on and come back to the Ruccella <br />proposal at the end of the meeting. <br />J. Maloney tabled Dominic Ruccella of 6691 Stearns Road until the next regularly <br />scheduled Board of Zoning Appeals meeting, as there was no one present to represent the <br />applicant. <br />6. Half Price Books, 4687 Great Northern Blvd. Ward 4: <br />Request for variance (1123.12). The proposal consists of new signage. <br />The following variance is requested: <br />1. A 23.67 square foot variance for a wall sign (code permits 80 sq. ft., applicant shows 103.67 <br />sq. ft.), which is in violation of Ord. 90-125 section (1163.24 (b)). <br />Chairman Maloney called all interested parties forward to review their request. Mr. Harnick, <br />owner of Accel sign Group and Mr. West, the district manager of Half Price Books each came <br />forward to be sworn in and address the request. Mr. Harnick indicated that the sign is a <br />national logo sign that is used throughout all their stores. They try to have the same look at all <br />their stores. The code allows 80 square feet and they require an additional 23.67 square feet. <br />The sign area is less than 7% of the overall storefront and is less than 12% of the overall sign- <br />3
