?' . <br />morning and very late at night. Mr. Allan questioned what size vehicles would be making <br />deliveries. Mr. Dalpiaz suggested that the majority of the trucks would be box-vans. However, <br />there will be deliveries from a tractor-trailer rig. The box-vans will be twice a day and the tractor- <br />trailer will be every other day or every fifth day depending on the volume of business. Mrs. Hoff- <br />Sinith again requested the outside ordering speaker be removed. Mr. Dalpiaz suggested that the <br />speaker is required to get the order ready quickly. To remove the speaker would be detrimental to <br />their business. li'Ir. Koeth requested the speaker be moved to the north curb, as the sound from the <br />box will carry over onto the residential property. The commission wants it away from the residents. <br />li9[r. Dalpiaz suggested they would turn the speaker 45 degrees and turn the speaker down. Ma-. <br />Koeth again requested the speaker be moved to the northeast corner of the site. Mr. Dalpiaz <br />believed that moving the speaker would be detrimental to their business and.indicated that they had <br />conducted studies and have strict requirements regarding the spacing requirements. Mrs. Hoff- <br />Sanith voiced that although the applicants do not want to be inconvenienced they should not be <br />inconveniencing the residents that have to live next to the site. <br />City Planners comments: <br />Ms. Wenger thanked the applicants for the changes they had made thus far and encouraged them to <br />continue to protect the abutting neighbors as they look at enhancing the landscaping and modifying <br />the lighting. They may also want to find trip generation figures to see how much traffic will be <br />pulled into the establishment and how it will influence the traffic at the intersection. <br />lZesident's comments: <br />Councilwoman at Large Kasler questioned if the use of the building was deemed to be a <br />restaurant, then the size of the lot is not large enough for the building as it is not 1.5 acres. She <br />asked Mr. O'Malley if sandwiches would be a permitted service. 1VIr. O'Malley suggested that as <br />there is not a definition for restaurant then the next question would be is there a definition for the <br />sale of food and beverages. Food can be donuts, bagels, pre-packaged items, retail sale of baked <br />goods includes confectionery, dairy products, delicatessen, fruits and vegetables. 1VIrs. Kasler <br />reviewed that research by the residents show that Allied Demeck is defined as franchises which are <br />quick service eateries including Dunkin Donuts, Baskin Robins, and Togo's. Togo's is a shop, <br />which makes made to order sandwiches and Mr. Dalpiaz stated that they do not have any, made to <br />order items. The three companies have joined to cover each meal of the day. Dunkin Donuts <br />covers the morning rush, Togo's picks up the lunch hours and Baskin Robins peaks in the evening. <br />The applicants refer to themselves on their web site as a restaurant. She questioned if the applicants <br />stated that there will not be a Togo's on the site then why is there a 7-foot sandwich bar shown in <br />the floor plan. She questioned if the floor plan had changed since the first plans were released or if <br />the sandwich bar was to be removed. She also questioned what the applicants were going to do for <br />the residents to the west to buffer their home from the noise and lights. Mrs. Bowman questioned if <br />the applicants submitted in writing as requested at the Architectural Review Board meeting a <br />written statement assuring the Building Commissioner that they are not a restaurant. She is <br />concerned that although they say they are not a restaurant now but six months from now it will turn <br />into a restaurant. She believes that a traffic survey is needed because there are traffic jams, and bad <br />accidents in the area now and will increase once this is built. She is also concerned about the site <br />being open 24 hours a day 7-days a week, which will mean more delivery, trucks to the site. She <br />questioned if there is truly a need to have a 24-hour drive-through in North Olmsted. Mr. <br />Sturgeon suggested that the county has to assign licenses to the applicants and questioned which <br />license they would be applying for. The existing apron is not the proper size for a two-lane ingress, <br />egress as it is 27-feet wide. He believes that the apron should be properly sized. He questioned <br />how there would be deliveries as Clague road is a no truck road. All their deliveries will have to <br />come off Lorain Road through CVS. He questioned how the applicants could use the CVS drive, as <br />11
