However, the association is now present and lets hope it can be worked out with Home Depot. <br />Ms. Hoff-Smith the association has an opportunity to work with Home Depot directly before they return <br />before the commission. <br />Further Comments by Residents: <br />1VIr. Hogan voiced his disappointment that the association had to contact Home Depot management to <br />set up a meeting. Councilman at large P. Miller suggested he became concerned at the first Building <br />Zoning and Development meeting as there were no residents from the association and they are one of the <br />better organized association in the city. When issues effect them, they are present to voice their opinions. <br />I3e appreciates that the commission wants to go forward that is what the Condominium Association <br />wants. The Association was very clear and firm that they were never notified, but want to correct the <br />situation they are not interested in pointing blame at anyone. When the Building Zoning and <br />Development brought Home Depot back it was for the residents to have an opportunity to be heard. The <br />new Home Depot Store Manager mentioned was present and was advised that Council was sending it <br />back to the Planning Commission for review. However, Council did not know when the next Planning <br />Commission meeting would take place due to summer vacation so no specific date was given to the store <br />manager. It would be our hope that the notice that went out to Illinois would some how trickle back, he <br />guessed it did not work that way within their organization. We need to get that store manager on record <br />and notify him, he did hear residents concerns and complaints and expressed interest in correcting as <br />many problems as he could. The major concerns of the residents are the fact that this site is going to <br />move 90-feet closer to them. The problem is although it is within the footprint of the property the <br />problems of sounds, noise, dust and lack of an effective mounding and landscaping is not being <br />addressed. He applauds the commission that they want to go forward to resolve the problem so hopefully <br />proper notice can get out to everybody to get this in the best interest of the residents. Mrs. Rote Voiced <br />that Home Depot was not mis-notified not only was the agenda and legal notice sent to the headquarters <br />they were also sent to the local store in North Olmsted. As well as the contractors, office and two to <br />Developers Diversified one on Brookpark Road and one in Beachwood Ohio. Mr. Lasko commented <br />that it now seems that the commission not only has mis-notification sort-of-speaking not only the <br />residents but perhaps Home Depot as well now. Therefore, he would gladly second the motion the <br />chairperson made earlier to table the matter. Until such a time that the residents can meet with Home <br />Depot to see what progress they might be able to make in terms of an informal discussion to bring this <br />matter to an acceptable neighborly conclusion. After that, opportunity is afforded Home Depot would <br />then return to Planning Commission. Mr. Lasko seconded Chairman Koeth's motion to table ttae <br />matter vvhich, was unanimously approved. Proposal Tabled. <br />Mr. Koeth indicated that he wanted the residents to meet with Home Depot's manager before the <br />proposal returns. The association will be given notice of the next meeting and it will be up to them to <br />notify the condominium owners. <br />2. Cingular Wireless, On raanp at Stearns Road & I-480, PP# 234-22-019, 001, 003 & 004 <br />Proposal consists of installing a permitted 190-foot self supported monopole tower & 11.5' X 20' <br />radio equipment pre-fab building in the I-480 state right of way. Note: Planning Commission tabled <br />this proposal on July 8, 2003 and July 22, 2003. <br />"APPLICANT HAS WITHDRAWN THIS PROPOSAL UNTIL FURTHER NO'TICE" <br />3. Berg Carwash 4700 Clague Road: WRD 2 <br />Proposal consists of obtaining a Use Permit for a carwash in a multi-family district. Note: Applicant <br />withdrew this proposal from Planning Commission on 7/22/03. City requires parcels be consolidated. <br />Chairman Koeth called all interested parties forward to review the proposal. Mr. Conway indicated that <br />the write-up is slightly misstated, the applicants need to apply to go before the Board of Zoning Appeals <br />4
