Mr. Spalding asked if there will be <br />any outside sales at Galyan's. Mr. Farrell confirmed that everything will be inside. 1VIr. Hreha <br />mentioned his previous requests to Galyan's, to which Galyan's agreed. He would like Westfield to <br />reach out and talk to Galyan's and remind them that they agreed to contact the city because it has a <br />multitude of sports programs geared for youth. He said this is a golden opportunity for Galyan's to <br />partner with some of those programs. Mr. I+'arrell said that Dave Labus, who attended the last <br />meeting, did mention this to him. He said the Galyan's web site, Galyans.com, lists the various <br />community involvement projects they currently have. He said it is an important part of their business. <br />Audience Questions and Comments <br />Mrs. Maruscak asked if the Galyan`s will be in the mall. Mr. Farrell reviewed the rending with the <br />audience. Mrs. Maruscak asked if the project will take away parking and 1VIr. Farrell explained it <br />will take some parking away but they may have a parking deck in the future. He explained the <br />entrances as well. <br />Law Department <br />NO COMMENTS <br />J. Lasko made a nnotion that the Westfield Mall proposal as it pertains to the expansion of the <br />north side of the center to include Galyan's, be approved with the incorporation of the <br />recommendations of the Architectural Review Board pertaining to the berms and mounding <br />11ong Brookpark Road as well as the decorative metal gate to be designed and submitted to the <br />city for approval, as well as the approval for any variance pertaining to the footprint in relation <br />to the lot coverage. The motion was seconded by W. Spalding and unanimously approved. <br />The clerk announced the proposal will proceed to the Board of Zoning and Development on August 4, <br />2003 at 7:00 p.m. No notices will be sent. <br />4. Cingular Wireless; On ramp at Stearns Road & I-480, PP# 234-22-019, 001, 003 & 004: <br />Proposal consists of installing a permitted 190 foot self supported monopole tower & 11.5' X 20' radio <br />equipment pre-fab building in the I-480 state right of way. Note: Planning Commission tabled this <br />proposal 7/8/03. <br />Applicant Presentation <br />Mr. Zerxis Satarawala of Infinity Site Development came forward on behalf of Cingular. He said he <br />is before the board because a year ago Cingular identified the need for cell coverage for their <br />customers along the intersection of I-480 and Stearns Road. He indicated he spoke with the Building <br />Commissioner, Dave Conway, and he met with Tom Rymarczyk recently. He also spoke with the <br />zoning inspector. He said they were given a search area that involved a 1/2-mile radius, a 1/4-mile <br />north of the intersection and a 1/4-mile south of the intersection. He said before even approaching any <br />property owner or approaching O.D.O.T., he met with the zoning and building department. He <br />indicated he is aware it is zoned 100% residential. As you go farther south into Olmsted Township, <br />they also have residential zoning. He shared this dilemma and he was given a copy of the city's <br />wireless telecomm regulations. He referred to regulation 1151.04, which specifies that wireless <br />companies are considered a permitted use. Mr. Satarawala then read a portion of the regulations. He <br />said he then checked the high-tension lines that run through the city and emerged basically on the <br />highway over on Grayton Road. He said currently AT&T has a pole insert at that location. He said the <br />board members should have received a coverage map explaining the propagation if Cingular was to <br />collocate on an existing tower. The map shows what happens at the eastern and northern section of <br />their search area. He said the northern edge has a greater amount of residents who live along that <br />stretch. He indicated they try to go by the letter of the law so they do not have to ask for a variance or <br />conditional use. He then referred to the city's code (1151.05) regarding minimum standards for towers <br />and the separation involved.
