He said to address the 190 foot issue, they only need the 150 feet <br />and if that is a recommendation of the board, they can approach O.D.O.T. and say they are at the max <br />at 150 and they can build a stackable tower. With a stackable tower, if 911 or the mark system needs <br />the additional height, they can add a chimney cap to the top of the tower and go to 175 or 180 feet. He <br />said they would be more than happy to cap the tower at 150. Mr. Koeth asked how much Cinb lar is <br />paying for this. Mr. Satarawala said he believes the lease with O.D.O.T. is $22,000 a year and then <br />they get an increase of 31/2% every year for 20 years. He said per Mr. Cheek's letter, the money that <br />goes to the state goes directly to road improvements. They also provide free collocation to the state <br />per their master lease agreement. He said the reason the state asked them to go through the City of <br />North Olmsted on this, as they did with T-Mobile, is addressed by Mr. Cheek in his l-etter. He then <br />read from the letter (see attached). Mr. Satarawala said that Mr. Cheek is saying that basically on <br />O.D.O.T. land, O.D.O.T. could give them a building permit and a zoning permit. He said that Mr. <br />Conway and Mr. Cheek spoke last week and Mr. Cheek explained that the state would like the city to <br />benefit from the permit fees for the zoning and building and any Architectural Review Board fees <br />required. That is why they were asked to go through the city. They could get a blanket zoning <br />exemption and a building permit from the state. 1VIr. Spalding asked if the two proposals in Olmsted <br />Township were along the high line, the illuminating company high line. Mr. Satarawala said that was <br />correct. Mr. Spalding asked if they examined the location of the high line at Lorain Road or in that <br />area, and if so what was the problem there. Mr. Satarawala said Mr. Kovitch did point out at the last <br />meeting that on the First Energy pole near Rodger's Towing, there are coverage gaps to the northwest <br />off Lorain and they could only insert about 10 feet above the highest point of the tower so they could <br />only be at 120 feet. At that distance, Mr. Kovitch said in his report there would be coverage problems. <br />He said if they went with the First Energy tower there would be a 1/4-mile gap to the north of the <br />system and they will be spending about $250,000 to build the site. Cingular has asked them to <br />maximize the usage of their funds to provide coverage to its customers. It just doesn't meet the <br />coverage objectives at all. He referred to the propagation map and said it is appropriate, and factual. <br />He said he would have preferred that the other site be used but they turned in the information as <br />candidate one and two, and they were told none of them would work for Cingular and there was no <br />need to waste the money. Mr. Hreha said he understands that some of the technological aspects are <br />that Cingular is in the third or fourth position on other towers. He believes the board's job is to provide <br />the residents access to technology, not necessarily to any singular provider. He said he is guessing the <br />reason they have a lower position on the towers is that Cingular entered the market place late. He said <br />he understands the owner of a tower will have the first position but if they had come in earlier they <br />could have rented the second spot. He said they do not have to subject our residents to this simply <br />because Cingular perhaps made a marketing error. Mr. Satarawala said that as soon as Cingular <br />entered the market they tried to make the pattern work. The pattern just does not exist. He said he <br />would like to ask Mr. O'Malley to give his interpretation of city code. He said that per Dave Conway, <br />they spoke on Thursday afternoon, he basically asked the commission to pass this through to the <br />Architectural Review Board because he said, "if you do not like the city code as to cell tower <br />placement on any highway property, then the objective of this commission is to change that code." Mr. <br />Satarawala said he is here under the existing code and he would ask Mr. O'Malley for his <br />interpretation. Mr. Hreha pointed out that the Commission does not change the code. That is <br />council's responsibility. Mr. Koeth said as he looks at the site map, they are talking about not having <br />coverage to the north. He said Cingular asked for two coverages to the south. He asked if it is correct <br />that the engineer indicated that would not work. Mr. Satarawala said that is correct. Mr. Koeth said <br />then why not take it up where the right of way keeps on going. He suggested taking it 1/2 way up and <br />then they are a 1/4 of a mile away from the intersection. Mr. Satarawala said the engineer only has a <br />1/2-mile radius to work with. Anything a 1/4-mile north of the intersection and anything a 1/4-mile <br />south of that will not work. Mr. Koeth said he would like a report from the engineer. Mr. <br />Satarawala referred to the photo rendering of the coverage area. Mrs. Hoff-Smith said that rendering <br />6
