ROLL CALL: <br />Acting Chairman Spalding called the meeting to order at 7:45 p.m. <br />PRESENT: Acting Chairman Spalding, Board members C. Allan, T. Hreha, K. O'Rourke, J. Lasko <br />and S. Hoff-Smith. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Assistant Building Commissioner T. <br />Rymarczyk, and Clerk of Commissions D. Rote. <br />ABSENT: Chairman R. Koeth. <br />H. REVIIEW AND CORRECTION OF MIlNUTES: <br />The Planning Commission minutes dated April 8, 2003 have been submitted for approval. <br />W. Spalding motioned to approve the Planning Commission minutes dated April 8, 2003 as written. <br />K. O'Rourke seconded the motion, which was unanimously approved. <br />Acting Chairman Spalding announced that the commission had an extensive agenda and there are a <br />few items that can be handled in a short duration so the agenda order will not be followed. <br />III. 1VEW DEVELOPMENTS AND 5UBDIVISIOlVS: <br />1. Lot Sulit plat for pominic Ruccella, of 6691 Stearns Road: <br />The proposal is to split Permanent Parcel Number 234-23-010 (3.2413 acres) into two parcels. The <br />first parcel will be 2.9864 acres, and the second parcel will be 0.2549 acre (or 11,103 sq. ft.). The <br />location is on the east side of Stearns Road and approximately 500 feet south of Interstate I-4890. <br />Zoning is B, Residence, Single. The existing parcel conforms to depth, frontage and area <br />requirements of the Zoning Code. <br />NOTE: 1). The proposed 0.2549 acre parcel will NOT conform to the frontage requirements of the <br />Zoning Code. The required frontage is 70 feet, and the proposed frontage will be 61.17 feet. The <br />proposed 0.2549 acre parcel will conform to the depth and area requirements of the Zoning Code. <br />2). The proposed 2.9864 acre parcel will conform to the depth, frontage and area requirements of <br />the Zoning Code. <br />3). The proposed 0.2549 acre parcel will no longer have a garage after the lot is split. A minimum <br />one-car garage is required by the building code. <br />NOTE: The Planning Commission referred this proposal to the Board of Zoning Appeals on <br />3/25/03. The Board of Zoning Appeals tabled the proposal 4/3/03 and granted the variance request <br />5/1/03 with 90 days to erect a new garage. <br />Applicants Presentation: <br />Acting Chairman Spalding called all interested parties forward to review the proposal. Mr. <br />Ruccella the owner came forward to review his request. Mr. Spalding reviewed the variance <br />granted by the Board of Zoning Appeals board. He questioned if the existing garage had been <br />demolished. Mr. Ruccella suggested that he was waiting for the final approval. He will then apply <br />for a demolition permit and submit new plans for a garage within the next week. He believes he only <br />has 90-days from 5/1/03 to get the garage built. <br />Building Department Comments: <br />1dIr. Rymarczyk indicated that the Building Department had no issues. <br />Law Departments Comments: <br />Mr. O'Malley recommends that if the commission grants the lot split they enforce the conditions <br />that were imposed by the Board of Zoning Appeals. He further recommended that Planning
