CITY OF NORTH OLIVISTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE!" <br />PLANNING COMMISSION <br />MINUTES - JANUARY 27, 2004 <br />IN COUNCIL CHAMBERS <br />7:30 P.M. <br />I. ROLL CALL: Chairman Koeth called tlle ineeting to order at 7:40 p.m. <br />PRESENT: R. Koeth, J. Lasko, M. Yager, and T. Hreha (Note: S. Hoff-Smith arrived late) <br />ALSO PRESENT: Planning Director K. Wenger, Assistant Law Director B. O'Malley, <br />Assistant Building Commissioner T. Rymarczyk, and City Engineer G. Durbin <br />ABSENT: W. Spalding <br />II. REVIEW A1VD CORRECTION OF MINUTES: The Planning Commission minutes dated <br />7anuary 13, 2004 have been submitted for approval. <br />R. Koeth made a motion to appi•ove the minutes as submitted. The motion was <br />seconded by J. Lasko and was unanimously approved. <br />Chairman Koeth announced the Commission has a quorum with four members present, but <br />an applicant needs to receive four affirmative votes for approval; one vote against a proposal <br />means it is denied. Applicants have the choice proceed on that basis or they can withdraw <br />their proposal until the next meeting. <br />M. BUILDING DEPARTMENT REQUESTS: <br />1. Dunkin Donuts/ Baskin Robbins; PP# 237-09-005 (Clague Road: (W12D 2) <br />Proposal consists of construction of a new Dunkin DonutsBaskin Robbins Retail building. <br />Note: The Architectural Review Board addressed the proposal on 11-19-03 and 12-17-03. <br />Planning Commission tabled the proposal 11-25-03, applicant withdrew on 1-13-04. <br />Variances are required. <br />The representative from Dunkin' Donuts indicated they wish to withdraw and return to the <br />next Planning Commission meeting. An audience member asked if the proposal is then <br />withdrawn from the upcoming Board of Zoning Appeals meeting. The clerk announced the <br />proposal will not go before the Board of Zoning Appeals on Thursday and said no notices <br />will be sent for its return to the Planning Coinmission. THE PROPOSAL WAS TABLED <br />AT `I'HE REQUEST OF THE APPLICAN'I'. <br />2. Ganlev Westside VW; 25600 i.ornin Road: (WItD 1) <br />Proposal consists of the construction of a third building, which will be 34,200 square feet and <br />house Ganley Westside VW. Note: The Architectural Review Board addressed the proposal <br />on 11-19-03 and approved the plan 12-17-03. Planning Commission tabled the proposal on <br />11-25-03 and Ganley withdrew on 12-23-03. Variances are required. <br />See NEW DEVELOPMENTS AND SUBDIVISIONS for discussion of the Ganley <br />proposals. <br />J. Lasko made a motion that the development proposal for Ganley Westside VW of <br />25600 Lorain be approved contengent upon the approval by Council of the rezoning <br />with the following stipulations: <br />1. No variance wauld be required. <br />2. The fencing along the north side of the parcel will include certain elements of <br />landscaped screening so that the cars will be additionally screened. <br />3. Should the parcel to the Yioi-th of the pi•operty be developed for residential purposes <br />as it is zoned, the existing pattei•n of both landscaping and fencing as proposed on the <br />west side of the property would then be continued along the entire north side of the <br />property. The motion was seconded by R Koeth and was unanimously approved.
