ROLL CALL: <br />Cha.izman Puzzitiello called the meeting to order at 5:30 p.m. <br />PRESENT: Chairman R. Puzzitiello, P. Engoglia, N. Althen <br />ALSO PRESENT: Asst. Law Director B. O'Malley, Building Commissioner <br />D. Conway <br />ABSENT: M. Conway <br />II. REVIEW AND CORRECTION OF MINUTES: <br />The Board of Building Code Appeals minutes for October 21, 2004 are <br />submitted for approval. <br />P. Engoglia motioned to accept the minutes as submitted. N. Althen seconded <br />the motion. <br />III. Old Business• <br />Robert & Kimberlv Gabele, 26567 Waterburv Circle, WRD 1 . <br />Proposal consists of a fence on the right side of property next to existing <br />neighbor's fence (39 foot section). Cannot install a fence on a propeity line <br />where a fence already exists per section 1369.03.03. An appeal is hereby <br />requested from the above rejection for the following reasons: Put up a fence 5 ft <br />off property line because of drainage line of 37 ft. Neighbor does not want a <br />fence attached to his fence. All possibilities have been exhausted to attach a <br />fence temporarily. <br />Mr. Gabele came forward and said the neighbor situated to the right of their <br />property would not accept any attachment to his fence, even though they <br />proposed having two gates. He said there is a sewer drain tha.t comes down his <br />side of the properly and he would like to come 5' off the property line and <br />install a fence 5' in from the property line. <br />P. Engoglia moNon to approve Mr. Gabele's fence 5 foot off the property <br />line straight down according-to the submitted plan. N. Althen seconded <br />which was unanimously approved. <br />IV.
