Proposal consists of a 6-foot high privacy fence which includes a 30 foot section <br />where a neighbor's fence already exists. VVhich is in violation of a Building <br />Code 1369.03 (A3)). <br />Wendel and Beverly Rountree presented photographs to the Board showing the <br />proposed 39' section of fence they are proposing to install next to the neighbor's <br />chain link fence. The neighbor, Mrs. Frabotta currently lives in Brecksville and <br />has not lived at her property for 10 years. Mrs. Frabotta's chain link fence is in <br />poor condition. The applicant sent Mrs. Frabotta xegistered letter requesting <br />permission to remove a sma11 section of her chain link fence that abuts their <br />property. They did receive a signature of approval. Several nearby neighbors <br />have also expressed their dissatisfaction with their property. They did, <br />however, say she does maintain the lawn, however, the shrubs are overgrown <br />and there are raccoons in the attic. N1r. Engoglia asked the applicant for the <br />neighbor's phone number and will contact them regarding this situation. <br />D. Conway said there are approximately fifteen homes in the City that are <br />currently vacant. He further stated it is not a violation if a house is vacant, as <br />long as property is maintained. Currently, there is legislation in front of Council <br />to toughen up tha properly maintenance ordinances. The applicant would like to <br />install their fence about 3' from the neighbor's fence. Tn order to keep the azea <br />clean, they want to put down red paving stones and landscaping between the <br />fences so that they can properly maintain it. Mr. Conway informed the <br />applicant to ask the company who will install the fence to submit a drawing to <br />tlae building departrnent to ensure that there are no violations of the zoning <br />code. <br />P. Engoglia IInotioned to approve the fence plan as presented, which is 3' off <br />the existing neighbor's fence with a jog where the fence negt door turns. <br />'I'hey will be able to access the neighbor's property at that point. A gate <br />will need to be installed at the point where the turn is ffiade in order to <br />maantain the area. N. Althen seconded the motion, whnch was unateimously <br />approved. <br />Theresa Krvsaak, 4170 Columbia Road, WRD 1: <br />Pursuant to Section 1331.05, Building Commissioner Conway has referred the <br />order to demolish 4170 Columbia Road structures to the Boaxd of Building <br />Code Appeals. For confirmation that a public nuisance does exist and that <br />failure of the owner or parties of interest to demolish the structure sha11 cause <br />the same to be abated by the city upon being directed to do so by Council, in <br />accordance with all the regulations and requirements of Section 1331.05. Note: <br />This proposal was tabled by the Board of Building Code Appeals on <br />Septernber 16, 2004. <br />The applicant was not present for this proposal.
