location on the penthouse wall to accommodate the sign that is going to be erected and will be
enclosed and painted to match the building so it will not be seen.
J. Maloney moved to grant Westbury Apartments of 25151 Brookpark Road their request
for variance (1123.12), which consists of erecting new signs on the building and that the
following variances are granted:
1. A 5' 4" variance for a wall sign higher than code permits, (code permits 41, applicant
shows 9'4"), section 1163.27C).
2. a 65 sq. ft. variance for a wall sign larger than code permits (code permits 100 sq. ft.,
applicant shows 165 sq. ft.), section (1163.27C).
3. A 4 foot 2 inch variance for a wall sing higher than code permits (north elevation), (code
permits 41, applicant shows 812"), section (1163.27 C).
4. A 4 foot 2 inch variance for a wall sign higher than code permits (south elevation), (code
permits 4', applicant shows 8' 211), section (1163.27 C).
5. A 25.5 square foot variance for a wall sign larger than code permits (north elevation),
(code permits 100 sq. ft., applicant shows 125.5 sq. ft.), section (1163.27 C).
6. A 25.5 square foot variance for a wall sign larger than code permits (south elevation),
(code permits 100 sq. ft., applicant shows 125.5 sq. ft.), section (1163.27 C).
7. A variance for more than 2 signs on a building, (code permits 2, applicant shows 3),
section (1163.27 A).
Which is in violation of 90-125, Section (1163.27C) and (1163.27 A) and in accordance with
the Architectural Review Board recommendations. W. Kremzar seconded the motion, which
was unanimously approved.
NEW BUSINESS:
1. William Scherer; 3169 Clague Road: (WRD 2)
Request for variance (1123.12). The proposal consists of a residence without garage.
The following vaxiance is requested:
1. A variance for an extension of time to not construct a garage until August 1, 2005, (code
requires garage, applicant shows none).
Which is in violation of Ord. 90-125 section (1161.08 (a) (1)).
Chairman Maloney called all interested parties forward to review the request. Mr. Scherer the
owner came forward to be sworn in and review the request. The applicant first apologized for not
completing the garage within the time frame his permit granted him in August. He stated that he
removed the garage, porch and then started work on the house, first water proofing the foundation
then painting. He would like additional time to purchase the materials to finish the project. He
would start work on the garage by early spring and hope to get it completed by end of summer. He
is hoping to break ground once winter and freezing season ends. As he is doing his own work and
only has time to work on the proj ects on the weekends it is taking longer then planed. He is trying
to finish the porch before freezing weather sets in. The board asked if the applicant would be able
to have all work completed by the August 1, 2005 deaciline. The applicant assured the board he
would have it completed by that time.
W. Kremzar moved to grant William Scherer of 3169 Clague Road his request for variance
(1123.12), which consists of a residence without garage and that the following variance is
granted: 1.
