2. Bernie Schmetzer; 23530 Mastic Road: (WRD 4)
Request for variance (1123.12). The proposal consists of a new accessory structure.
The following variance is requested:
1. A 1240 square foot variance for an accessory storage barn, larger than code permits, (code
permits 200 sq. ft., applicant shows 1440 sq. ft.), section (1135.02 (D) (1)).
2. A 10 foot variance for an accessory structure higher than code permits, (code permits 12',
applicant shows 22'), section (1135.02 (D) (3)).
3. A variance for three storage structures on a residential lot, (code permits 1, applicant shows 3),
section (1135.02 (D) (1)).
Which is in violation of Ord. 90-125 sections (1135.02 (D) (1)) &(1135.02 (D) (3)).
Note: Rear yard = 130 x 225= 29250
x.20%
5850 allowed for accessory structures
Chairman Maloney called all interested parties forward to review the request. Mr. Schmetzer the
owner came forward to be sworn in and review the request. The applicant would like to place a
shed on the back portion of his lot which is quite large and requires a lot of lawn tools to maintain.
It will be designed to look like an original barn that was once on the property. The board asked
what would be done with the existing sheds. The applicant indicated that one shed is an existing
chicken coop used for their goat, and the other can not hold the large gardening equipment. The
chairman reviewed the engineer's letter requiring the barn have downspouts and properly drained.
The owner stated that he spoke with City Engineer Becker who stated that he could tie the
downspouts into the existing culvert that runs the length of the side of his property. Building
Commissioner Conway indicated that the land is quite large and if it was based on square footage
alone the applicant would be allowed over 4,000 square feet due to the size of the lot. His only
concern is that the storage/barn is not used for storing cars or used as a business. The applicant
stated that is just for lawn equipment. Mr. Lynn, a Neighbor came forward to be sworn in and
address the board. Mr. Lynn felt that Mr. Schmetzer had done nothing but tasteful things to the
property since he purchased it and had no objections to his neighbor's request.
W. Kremzar moved to grant Bernie Schmetzer of 23530 Mastic Road his request for
variance (1123.12), which consists of a new accessoY-y structure and that the following
variance is granted as amended:
1. A 1240 square foot variance for an aceessory storage barn, larger than code permits,
(code permits 200 sq. ft., applicant shows 1440 sq. ft.), section (1135.02 (D) (1)).
2. A 10 foot variance for an accessory structure higher than code permits, (code permits 12',
applicant shows 22'), section (1135.02 (I3) (3)).
3. A variance for three storage structures on a resiciential lot, (code permits 1, applicant
shows 3), section (1135.02 (D) (1)).
Which is in violation of Ord. 90-125 sections (1135.02 (D) (1)) & (1135.02 (D) (3)). The
building is not to be used for storage of cars or usecl to house a business. N. Sergi seconded
the motion. Roll call on the motion J. Maloney, W. Kremzar, T. Kelly, N.
