` triangle. The board felt that the continuous changes and returns to the board were wasting not only
the applicant's time but the boards as well. The applicant suggested that if the board did not approve
the request then there would be a face change to the existing sign which does not require their
approval. The board questioned why the applicants required 3 ground signs. The applicant stated
that they already liave three signs and the new sign is smaller than the existing. Mr. Rymarczyk
reiterated that the iiew sign will have to be 5-feet out of the right-of-way.
J. 1VIaloney moved to grant Bank One of 4763 Great Northern Blvd, their request for variance
(1123.12), which consists of new sign and that the following variances are granted as amended.
1. t1 variance for 3 ground signs on a lot (note: #1), (code permits 1, applicant shows 3),
section (1163.26 A).
2. A 12.5 foot variance for a ground sign too close to a side property line, (code r-equires 20',
applicanl shows 7.5'), section (1163.26 B).
3. A variance for a traffiie hazard (sign located within 35' triangle), (code does not permit 0',
applicant shows 1'), section (1163.17 A). This sign is to be 5-feet back from the right-of-
way.
4. A 152 foot variance for ground signs too close together, (code requires 200', applicant
shows 48') section (1163.26 A).
Which is in violation of Ord. 90-125 sections (1163.26 A), (1163.26 B), and (1163.17 A). W.
Kremzar seconded the motion, roll call on the motion; J. 1Vlaloney, W. Kremzar, T. Kelley and
N. Sergi "yes", M. Diver "no". Mrs. Sergi indicated the only reason she voted yes is that the new
sign will be safer. However, she is not happy the way the company handled coming back so many
times.
2. Mercv & IVIartan Akno-Esambe; 4167 Laurell Lane, WRID 1
Request for variance (1123.12). Proposal consists of erecting a storage shed.
The following variance is requested:
1. A 4 foot variance for an accessory building closer to rear lot line than code permits, (code requires
10', and applicant shows 6').
Which is in violation of Ord. 90-125, section (1135.02 D4).
Note 41: 1'ermit was issued 7/26/04 for this shed, as it originally complied to city ordinances.
Request for variajice was made after it was issued. Permit on hold until the Board of Zoning
Appeals reviews the applicants variance request.
Chairman Maloney called all interested parties forward to review the request. Mr. & N1rs. Akpo-
Esambe came forw•ard to be sworn in and review the request. The owners indicated that they want
the shed 6-feet from property line and the shed will be an 8 x 8 shed. The applicant believes that the
shed will be more than 20 feet from the drain. If the shed is placed to code it will be closer to the
drain then what they are proposing. The board voiced a concern regarding the engineers report and
the CEI lines being so close to the shed. The applicant indicated that he thought of placing the shed
at the other sic!e of the property but if it is placed on the other side it would be at the base of the CEI
pole. The board requested the City eiigineer go to the site to make sure what the location of the
drain truly is and to better advise the board were the shed should be placed.
W. Kremzar moved to table Mercy & Martin Akpo-Esambe of 4167 Laurell Lane until
meeting next. N. Sergi seconded the motion which was unanimously approved. The clerk was
asked to request thc engineer visit the site so he/she can advise the board.
3. Christine L. Haff-Paluck; 6667 Charles Rd, WRD 3
Request for variance (1123.12). The proposal consists of a garage addition.
The following variance is requested:
1. A 284 sq. ft. variance for a detached garage larger than code permits, (code permits
750 sq. ft., applicant shows 1034 sq. ft.).
Which is in violation of Ord. 90-125 section (1135.02 (C1)).
Note#1: Existing garage is 484 sq ft, and the additional proposed garage is 550 sq ft. The total
square footage after proposed addition would be 1034 sq. ft.
2
