8. Kim Rock• 5938 McKenzie Road: WRD 3
Request for variance (1123.12). The proposal consists of a detached garage.
The following variance is requested:
1. A 2 foot variance for a detached garage higher than code permits, (code permits 15 ft and
applicant shows 17 ft).
Which is in violation of Ord. 90-125 section (1135.02 (C1)).
Chairman Maloney called all interested parties forward to review the request. Mr. Witt, the owner's
fiance came fonvard to be sworn in and review the request. Mr. Witt reviewed that they had a
garage fire which requires that they rebuild the garage. They will be using the existing footers once
what is left of the old garage is demolished. The old garage had a leanto patio which did not look
good so they would like to have pillars and to accommodate snow pitch it works out to 17-foot. The
board felt that the lieight of the roof was too high. The applicant indicated that with a 15-foot pitch
the snow would accumulate on the roof and not run off. The home is quite small and the attic was
converted into a bedroom therefore there is no storage area in the home. The board indicated that
downspouts must be connected to the drain. Mr. Rymarczyk stated that the building department is
requesting that there is no living quarters, above the garage.
J. Maloney moved to grant Kim Rock of 5938 McKenzie Road her request for variance
(1123.12), which consists of a detached garage and that the following variance is granted as
amended. A 2 foot variance for a detached garage higher than code permits, (code permits 15
ft and applicant shows 17 ft). The garage will be required to have downspouts tied into sewer
and there is to be no living quarters on the second floor of the garage. Which is in violation of
Ord. 90-125 section (1135.02 (Cl)). W. Kremzar seconded the motion which was unanimously
approved.
9. Tim & Carrie Montie; 23123 Stonevbrook IDrive: WRD 2
Request for variance (1123.12). The proposal consists of a new shed.
The following vai-iance is requested:
1. A 4 foot variance for a storage shed too close to the rear property line. (code requires 10'
applicant shows 6').
Which is in violation of Ord. 90-125 section (1135.02 D4).
Chairman Maloney called all interested parties forward to review the request. Ms. Montie, the
owner, and Ms. DeBrodt, a neighbor each came forward to be sworn in and review the request. The
applicant reviewed that there once was a shed in the rear yard which included a cement slab and they
would like to reuse the existing slab to place a new shed. The applicant showed pictures of existing
slab to board members. The board asked if the height of the shed would be impeded by the CEI
lines. The applicant does not feel that the CEI lines would interfere with the shed. T'he neighbor
indicated that she Nvas present to support the applicant. The board suggested the applicant have CEI
visit their home to check the height of their lines as they look low. Mr. Rymarczyk advised the
applicant that a standard shed is 10 feet high and the plans show 6-feet. The applicant stated that it
is a kit and will be a standard size. Mr. Rytnarczyk suggested that as long as the height is not over
12-feet the height Nvould be within code.
N. Sergi moved to grant Tim & Carrie Montie of 23123 Stoneybrook Drive their
request for variance (1123.12), which consists of a new shed and that the following
variance is granted: A 4 foot variance for a storage shed too close to the rear property
line.
