1. A variance for changing a non conformation pole sign, (code does not permit, applicant shows <br />one), section ( 1163. 10 (c)). <br />2. A 1 1/2 foot variance for a sign too close to right of way, (code requires 5 ft, applicant shows 3 <br />'/2'), section (1163.26 (b)), (see note 1). <br />3. A variance for 2 ground signs on a lot, (code permits 1, applicant shows 2), section (1163.26 <br />(A)), (see note 2). <br />Which is in violation of Ord. 90-125 sections (1163.10 (C)), (1163.26 (A) &(b)). <br />Note: 1. Existing pole sign is 1 foot into right-of-way. Proposed change will bring it 3'/z feet away <br />from right-of-way. 2. Applicant is not requesting to add another ground sign, only change & improve <br />existing sign. 3. Overall height of sign 22 feet. <br />At the re4uest of the applicant this proposal was tabled until the October 2004 Board of <br />Zoning Appeals nieeting. <br />11. Westfield Shopping Center; 4954 Great Northern Blvd: W12D 4 <br />Request for variaiice (1123.12). The proposal consists of an extension of time for previously <br />approved variance. <br />The following variance is requested: <br />A 14 month ea-tension for variance previously granted July 9, 2003. <br />Which is in violation of Ord. 90-125 sections (1123.15). <br />Chairman Maloney called all interested parties fonvard to review the request. Mr. Pildes, Vice <br />Present of development for Westfield shopping center, and Mr. McIntosh, General Manger of <br />Westfield center each came forward to be sworn in and review the request. The applicants would <br />like to get an eatension of time on the variances that they were granted last year. They had <br />anticipated having leases for the sites within a year but they have not quite finalized them yet. They <br />believe that it will take a few more months and then the proposals will have to go through the <br />approval process. Mr. Rymarczyk stated that the applicant's have kept the building department well <br />informed as to whst is going on and has been providing docurnentation prior to the expiration time. <br />The building depai-tment would have no objections if the board granted the applicants the additional <br />time. <br />M. Sergi moved to grant Westfield Shopping Center of 4954 Great Northern Blvd their <br />request for variaiice (1123.12), which consists of an extension of time for previously approved <br />variance and the following extension is granted: A 14 month (August 2005) extension for <br />variance previously granted July 9, 2003. Which is in violation of Ord. 90-125 sections <br />(1123.15).1VI. Diver seconded the motion which was unanimously approved. <br />12. Dicks Sqorting Goods; 200 Great Northern Mall: WRD 4 <br />Request for variance (1123.12). The proposal consists of new signage for Dick's Sporting Goods <br />(fonnerly Galyan's). The following variances are requested: <br />1. A 6 foot 4 incli variance for a wall sign higher than code permits (north), (code pernuts 4 ft. and <br />applicant shows 10 ft. 4 inch). <br />2. An 8 foot variance for a wall sing higher than code permits (west), (code permits 4 ft., applicant <br />shows 12 ft.). <br />3. An $ foot variance for a wall sign higher than code permits (east), (code permits 4 ft., and <br />applicant shows 12 ft.). <br />Which is in violation of Ord. 90-125 sections (1163.27 (C)). <br />Note: 1. Variances previously approved July 7, 2004 for total sq. ft. number of wall signs, sq. ft. of <br />individual signs & height variances. 2. height variances were granted for 2 ft., however, with the <br />revised signage the above height variances are requested. <br />Chairman Malonev called all interested parties forward to review the request. Mr. Mikula, with <br />Dick's Sporting Goods, Mr. Belknap with Mc Signs each came forward to be sworn in and review <br />the request. Applicants reviewed that the area belund the lettering will not be illuminated only the <br />letters. The board questioned why each signs was a different size. The applicants voiced that they <br />7
