2e A 12.5 foot variance for a ground sign too close to a side property line, (code <br />requires 20', applicant shows 7.5'), section (1163.26 B). <br />3. A variance for a traffic hazard (sign located within 35' triangle), (code does not <br />permit 01, applicant shows 1'), section (1163.17 A). <br />4. A 152 foot variance for. ground signs too close together, (code requires 200', <br />applicant shows 481) section (1163.26 A). <br />Note: #1. This includes an egisting multi tenant sign and an existing pole sign. <br />#2. Changed variance required to 1 directional sign only. <br />Which is in violation of Ord. 90-125 sections (1163.26 A), (1163.26 B), and (1163.17 A). <br />W. Kremzar seconded the motion. Roll call on the motion W. Kremzar and J. Maloney <br />"yes", N. Sergi with the following comments; she feels that the business can function <br />without the sign and does not see a hardship. <br />After a brief discussion regarding only three board members being present and applicants <br />requiring three affirmative votes to grant or deny the following motions were made. <br />N. Sergi moved to reconsider the vote. W. Kremzar seconded the motion which was <br />unanimously approved. <br />N. Sergi moved to continue the proposal to the next Board of Zoning Appeals meeting <br />dated September 9, 2004. W. Kremzar seconded the motion which was unanimously <br />approved. <br />2. Robert and Sandra Rock, 3153 Clague Road: WRD 2 <br />Request for variance (1123.12). The proposal consists of erecting a fence. . <br />The following variances are requested: <br />1. An 18 inch variance for a fence too high in a neighbors front setback on a corner lot, <br />(code permits 30", applicant shows 48"), section (1135.02 F1). <br />2. A 50 foot variance for a fence higher than 30 inches placed in neighbor's front setback, <br />code permits 0, applicant shows 50'), section (1135.02 F2). <br />Note: Application is for a 4' chain link fence, which is greater than 50% open. <br />Which is in violation of Ord. 90-125 section (1135.02 F1 & F2). <br />Chairman Maloney called all interested parties forward to be sworn in and review the <br />request. Mr. Rock, the owner and Mr. Planovsky a neighbor, each came forward to be sworn <br />in and address the proposal. The applicant would like to have an area for his dogs to run. <br />The fence will be chain link and 4 feet high and the pens will be removed from the frorit <br />yard. W. Planovsky was present to find out what the fence would look like. He was not in <br />favor of a fence as there had never been a fence in the past. The board questioned if the <br />applicant would Ue able to maintain the grass area. The applicant indicated that he would cut <br />the grass by hand if he had too but his pets needed an area in the yard. <br />W. Kremzar moved to grant Robert and Sandra Rock, 3153 Clague Road their request <br />for variance (1123.12), which consists of erecting a fence and that the following <br />variances a.re granted: <br />1.
