N. Sergi moved to grant Scott Manley of 5257 Dover Center Road his request for <br />_ variance (1123.12), which consists of a patio cover and that the following variance is <br />granted: <br />1. A 6 foot variance for an accessory structure too close to rear property line, (code <br />requires 10', applicant shows 4'). Which is in violation of Ord. 90-125 section (1135.02 <br />(D 4)). W. Kremzar seconded the motion which vvas unanimously approved. <br />5. Jason & Danielle Timms; 25527 Butternut Ridge Road: (VVRD 4) <br />Request for variance (1123.12). Proposal consists of building a detached garage. <br />The following variances are requested: <br />1. A 1973 square foot variance for total square foot of all garages on a lot, (code permits <br />750 sq. ft., applicant shows 2723 sq. ft.), section (1135.02 (C 3)). <br />2. A variance for a 750 foot gravel driveway and 40' x 40' gravel turnaround, (code <br />permits 0, applicant shows expanding existing drive), section (1161.11 (A)). <br />Which is in violation of Ord. 90-125 sections (1135.02 (C 3)) and (1161.11 (A)). <br />Note: Existing attached garage is 17' x 19' (323 sq. ft.) applicant shows adding a new <br />detached garage 60' x 40' (2400 sq. ft.). <br />Chairman Maloney called all interested parties forward to review the request. Mr. & Mrs. <br />Timms the owners, Mr. Crabs, a neighbor and Mr. Garearu Sr., Mr. Crabs attorney each <br />came forward to be sworn in and review the request. The applicant indicated that after <br />meeting with the Assistant Engineer regarding drainage issues the garage will be 30-feet <br />from the rear yard line. The applicant indicated that an underground stone catch basin 5 feet <br />deep and 15' x 15' would be installed and the engineer's recommendations would be <br />followed. The applicants own and work on classic cars, they currently have 4 classic cars <br />that they would like to house in the garage as well as the three cars they currently drive. <br />Currently the owners have to rent storage garages to house the classic cars and he would like <br />them in the new garage so he can work on them. If the 40' x 60' garage is granted he will <br />remove the dilapidating shed that is currently in the backyard. The applicant also indicated <br />he needs room to store, picnic tables, log splitters, yard tools, riding mower, hobby tools, <br />and a utility trailer. The applicant indicated that they live in the historical district and <br />received a certificate of appropriateness from the Landmark Commission. He would like to <br />be allowed to have the gravel driveway and the garage as sized. If a hard surface driveway <br />is required two trees which are 50 years old would have to be removed. Landmarks stated <br />that they would prefer one building not multiple buildings and they do not want the garage <br />seen from street. The applicant believes that it would help them clean the yard and it would <br />not be visible from the street. They do not believe that the garage would take away from the <br />historical district and the gravel drive would help the drainage issues Mr. Crabs has. Mr. <br />O'Malley advised that the criteria for the Landmarks Commission are different from that of <br />the Board of Zoning Appeals. He asked if the clerk provided the Board of Zoning Appeals <br />members copies of the certificate of appropriateness or excerpts of the minutes. The clerk <br />advised that the Board of Zoning Appeals members received an excerpt of the June 14, 2004 <br />Landmark minutes pertaining to the Timms certificate of appropriateness granted. The clerk <br />advised that the original certificate of appropriateness is submitted to the Building <br />Department as soon as it is granted. The applicant submitted a copy of the certificate of <br />appropriateness which was marked (Timms exhibit A 7/7/04 Dr.) The applicant stated that <br />although the garage is big it does not exceed 20% rear yard coverage. If the garage was <br />based on 20% of the rear yard total coverage which is 96 feet wide and 480 feet long and <br />20% of that would allow a 9,216 square foot structure and they are asking for a 2400 square <br />5
