foot building. Mrs. Timms stated that the color of the garage was changed to accommodate <br />Mr. Crabs and they addressed the drainage issues brought up. Attorney Gareau cross <br />examined the applicant questioning how far from Mr. Crabs house the garage would be <br />placed, how close the garage is to the applicants own house, if the applicant could use his <br />land if the variance is not granted, asked if applicant felt the garage would adversely impact <br />Mr. Crabs, applicant was asked if he discussed the size of garage or how close it would be to <br />the crabs home with Mr. Crabs, applicant was asked if he was aware of the land being <br />residential and that zoning codes exist and would have to be followed when he purchased <br />the house in 2002. A brief discussion regarding Mr. Crabs 10 acre horse farm existing in <br />the area prior to the area being zoned residential and the smells blown over from Mr. Crabs <br />horse barn. It was stated that the topography and drainage issues had existed as long as the <br />farm was in place. The attorney asked if the applicant could store cars in an 800 square foot <br />garage. The applicant stated that he could not store his four classic cars and the three cars <br />driven by him and his wife in an 800 square foot garage. It was discussed that at landmarks <br />the applicant stated that he was going to use the garage as a workshop and house band saws, <br />sanders, grinders and other power tools. The applicant indicated that those tools are <br />required for his hobby. Mr. Gross was brought forward to be sworn in and review the <br />request. Mr. Gross voiced that no matter where you live there is drainage issues. Gravel <br />will drain water quicker then hard driveway. He will see the garage from his home and has <br />no objections to the garage. The attorney cross examined Mr. Gross asking if he knew the <br />garage was only 200 feet from Mr. Crabs home and if he would want a garage that size 200 <br />feet from his house. Mr. Gross stated that he was not aware it was that close to Mr. Crabs <br />home. The board questioned if the garage was closer to Mr. Crabs horse barn or his home. <br />Mr. Crabs stated it was 150 feet from horse barn and 200 feet from his house. The applicant <br />indicated that at the request of the Landmarks Commission there will be landscaping around <br />three sides of the garage which will buffer Mr. Crabs view. Mr. Crabs presented a site plan <br />which was marked (Crabs submit exhibit A 7/7/04 Dr.), he reviewed were his home is <br />located, Mr. Timms home and Mr. Gross's home. Using an engineering scale Mr. Crabs <br />stated that the garage would be 190 feet from his front door and 300 feet from Mr. Timms <br />back door. Mr. Crabs voiced that he did not want a working garage that close to his home. <br />He suggested that the applicant could reduce the size of the garage and move it closer to his <br />own home. It was disclosed that Mr. Crabs is a registered Engineer and assured the board <br />that the plan presented was an accurate plan of the area. Mr. Grabs stated that an asphalt <br />driveway has a runoff of 85% to 95% and a gravel driveway runoff is 65% to 75% so gravel <br />has 10% less runoff then asphalt. He stated he took his figures from city code 927. 08 and <br />presented copies to the board which were marked (Crabs submit exhibit B 7/7/04 Dr). Mr. <br />Timms was given a copy of the Crabs submit exhibit B 7/7/04 Dr. and indicated that he had <br />a copy of the City Engineers report. Mr. Crabs voiced that the applicant is asking for 2.6 <br />times what the code allows. He felt that his property would be devalued as well as the <br />neighborhood. Mr. Crabs submitted photographs of his backyard as well as Mr. Timms <br />backyard and front drive which were marked (Crabs submit exhibits C, D& E 7/7/04 Dr.). <br />Mr. Crabs reviewed each photo submitted and felt that the garage would increase the <br />amount of standing water in his yard. Mr. Crabs then read allowed the City Engineers letter <br />regarding drainage issues which need to be addressed. Mr. Crabs voiced the size detention <br />basin he thought the Timms would need and indicated that that would be very expensive as <br />soil conditions and tests need to be conducted. The applicant read allowed Regulations for <br />detached garages which he received from the Building Department. A private detached <br />garage shall be located not less than 15-feet from any dwelling on the same lot or adjacent <br />lots and his garage is a lot further than that from the neighbor's home. Mr. Timms asked <br />Mr. Crabs if he knew many residential lots in North Olmsted which had working horse <br />6
