pool area be fenced in as well. 4). Neighbors are concerned about the view from their homes will be
restricted by the fence. Mr. Sullivan does not think the neighbor's ground sign will be blocked by
his fence. The board voiced a frustration over the diagram they were provided as it did not seem to
be accurate. However, the only issue before the board is the placement of the side yard fence from
the sidewalk. There are no violations concerning the placement of the rear fence.
N. Sergi motion to grant Michael & Helen Sullivan of 7120 Barton Road their request for
variance (1123.12), which consists of installing a fence and the following variance, is granted:
1. A 16 foot variance for a fence erected within the 25 foot required side yard setback, (code
requires 25', and applicant shows 9').
Which is in violation of Ord. 90-125 section (1135.02 (F2)). W. Kremzar seconded the motion,
which was unanimously approved.
Tom Sloane; 3493 Beaumont Drive: (WRD 2)
Request for variance (1123.12). The proposal consists of building a storage garage.
The following variances are requested:
1. A 303 square foot variance for excess square footage of a detached garage in conjunction with
an existing attached garage, (code permits 750 sq. ft, and applicant shows 1053 sq. ft.), section
(1135.02 (0)).
2. A variance for erecting a garage with no approved access driveway, (code requires concrete or
bituminous concrete, applicant shows none), section (1161.11 (A)).
Which is in violation of Ord. 90-125 sections (1135.02 (0)) and (1161.11 (A)).
Chairman Maloney called all interested parties forward to be sworn in and review the request. Mr.
Sloane the owner came forward to be sworn in and review the request. The applicant would like to
build a storage garage for his historical vehicles which remain stored most of the year. He would
also like to store his lawn tools in the new garage. The existing storage shed would be removed once
the new garage is built. The applicant would like to maintain the green space around the garage. He
felt that not having a driveway to the garage would not cause damage to the lawn as he would only
remove the cars in the late spring and summer months. The Board felt the garage was oversized
considering there is already a two car garage. The board asked if the applicant would be willing to
decrease the size of the proposed garage. Mr. O'Malley advised the applicant that the garage could
not be used for commercial use. The applicant did not wish to decrease the size of the garage. The
board was also concerned that there is no driveway proposed for the garage.
J. iVIaloney motion to grant Tom Sloane of 3493 Beaumont Drive his request for variance
(1123.12), which consists of building a storage garage and the following variances, are granted
as amended: A storage garage which will be 24' x 30' on the condition that the exnsting storage
shed of 12' x 20' be removed and that the builcling will not be used commercially. The
applicant is to remove the existing shed within 30 days of the garage being completed. W.
Kremzar seconded the motion, Roll call on the motion W. Kremzar, and N. Sergi "no", T.
Kelly and J. Maloney "Yes". Motion failed Variances Denied
Tom Dipert; 6080 Decker Road: (WRD 3)
Request for variance (1123.12). The proposal consists of a garage addition.
The following variance is requested:
1. A 290 square foot, variance for a detached garage larger than code allows, (code permits 750 sq.
ft., and applicant shows 1040 sq. ft.).
Which is in violation of Ord. 90-125 section (1135.02 (C1)).
Chairman Maloney called all interested parties forward to be sworn in and review the request. Mr.
Dipert the owner came forward to be sworn in and review the request. The applicant would like to
add an additional bay to his existing garage to store lawn tools in the garage. He would be adding a
14' x 26' additionally to the existing garage making the total size 40' x 26'. The Board asked what
the applicant's hardship for the addition was. The applicant voiced that he needs to be able to house
