CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARD OF ZONING APPEALS <br />MAY 6, 2004 <br />NIINUTES <br />I. ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman J. Maloney, Board members; W. Kremzar, N. Sergi and T. Kelly. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Building Commissioner D. <br />Conway and Clerk of Commissions D. Rote. <br />Chairman Maloney reviewed that there were 9 cases requesting 26 variances and 2 special <br />permits on the docket. The Chairman advised that the board members had viewed the <br />premises involved for each case. Three votes are required for approval. In addition, each <br />case will be judged on the physical situation peculiar to itself, so that in no way is a <br />judgment rendered considered to be a general policy judgment affecting properties and like <br />situations elsewhere. <br />U. REVIEW AND CORRECTION OF MINUTES: <br />The Board of Zoning Appeals minutes dated April 1, 2004 have been submitted for <br />approval. <br />W. Kremzar moved to approve the April 1, 2004 minutes as written. T. Kelly <br />seconded the motion, which was unanimously approved. <br />III. BUILDING DEPARTMENT REQUESTS: <br />1). Bob & Colleen Vienna; 26112 Bvron Driver: (WRD 1) <br />Request for variance (1123.12). Proposal consists of erecting a fence. <br />The following variances are requested: <br />l. A 25 foot variance for a 6 foot fence installed in front setback of neighbor on a corner lot, <br />(code permits 0", applicant shows 25'), section (1135.02 F2). <br />2. A 42 inch variance for a fence in a 50 foot front setback, (code permits 30", applicant <br />shows 72"), section (1135.02 F1). <br />3. A variance for a fence less than 50% open face installed in a front setback, (code requires <br />50% open, applicant shows 0%), section (1135.02 F1). <br />Which is in violation of Ord. 90-125 sections (1135.02 F1) &(1135.02 F2). <br />Chairman Maloney called all interested parties forward to review the request. Mr. Vienna <br />the owner came forward to be sworn in and review the request. The applicant would like to <br />follow the side yard to Shelley Road and replace a section of his neighbor's fence with a new <br />section of fence. The layout of the house on the corner lot gives abutting neighbors a straight <br />view into his home. He needs a fence for privacy and for security, as there is a large hot tub <br />in the backyard. <br />N. Sergi moved to grant Bob & Colleen Vienna of 26112 Byron Driver their request for <br />variance (1123.12), which consists of erecting a fence and that the following variances <br />are granted: <br />1.
