ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman J. Maloney, Board members; W. Kremzar, N. Sergi, and T. Kelly. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Planning Director K. Wenger, and Clerk of <br />Commissions D. Rote. <br />Chairman Maloney reviewed that there were 5 cases requesting 11 variances and 2 special permits. He <br />advised that Dunkin Donuts had withdrawn their request and would not be addressed. The Chairman <br />advised that the board members have viewed the premises involved for each case. Three votes are <br />required for approval. In addition, each case will be judged on the physical situation peculiar to itself, so <br />that in no way is a judgtnent rendered considered to be a general policy judgment affecting properties and <br />like situations elsewhere. <br />II. REVIEW AND CORRECTIO1vT OF MIlVUTES: <br />The Board of Zoning Appeals minutes dated March 4, 2004 have been submitted for approval. <br />Note: The review and correction of minutes were addressed under Communications. <br />M. BUII.DING DEPARTNIEENT REQUESTS: <br />1). Kevin Dunn; 23781 Gessner Road (PP# 231-29-003), (WRD2): <br />Request for variance (1123.12). Proposal consists of a new detached garage. <br />The following variances are requested: <br />1. A 657 square foot variance for a detached garage in combination with an existing attached garage, <br />(code permits 750 sq.ft., applicant shows 1407 sq.ft), section (1135.02 (6)). <br />2. A 10 foot variance for a detached garage too close to a dwellina, (code requires 15', applicant shows <br />5'), section (1135.02 (c2)). <br />3. A 114 square foot variance for size of the detached garage, (code permits 750 sq.ft., applicant shows <br />864 sq.ft), section 1135.02 (cl)). <br />4. A 5 foot variance for a detached garage higher than code permits, (code permits 15 ft., applicant <br />shows 20 ft.), section (1135.02 (cl)). <br />Wluch is in violation of Ord. 90-125 sections, (1135.02 (cl)), (1135.02 (c2)), and (1135.02 (6)). <br />Note: Homeowner to extend concrete drive unless variance is asked for. <br />Chairman Maloney called all interested parties forward to review the request. Mr. Dunn the owner came <br />forward to be sworn in and review the request. Board members had many concems regardina the size <br />and location of the garage and after a lengthy discussion the board requested the applicant modify his <br />plans. The applicant agreed to be tabled and resubmit a new plan to try to eliminate as many of the <br />variances he could. <br />W. Kremzar moved to table Kevin I)unn of 23781 Gessner Road lus request for variance (1123.12) <br />evhich consists of a new detached garage until new plans are submitted and variances are <br />deteruuuede N. Serga seeonded the motion, which was unanimously approved. Tabled <br />2). Scott & Kim Crisfield; 3919 Clague Aoad: (PP# 237-12-001), (BVRD 2): <br />Request for variance (1123.12). Proposal consists of a new fence. <br />The following variances are requested: <br />1. An 18 inch variance for too hi;h within a neighbors 50' front setback on a corner lot, (code permits <br />30", applicant shows 48"), section (1135.02 (fl)). <br />2. A 49 foot variance for a 4 foot fence witlun a neighbors 50' front setback on a comer lot, (code <br />requires 50', applicant shows 1'), section (1135.02 (f2)). <br />Which is in violation of Ord. 90-125 sections, (1135.02 (fl)) and (1135.02 (fl)).
