The following variance is requested: <br />1. A 4 foot variance for rear yard requirements, (code requires 50 ft., applicant shows, 46 ft.). <br />Which is in violation of Ord. 90-125 section (1135.08 (A)). <br />Chairman Maloney called all interested parties forward to review the request. Mr. & 1VIrs. Mowchan, the <br />owners, and Ms. Sherman, the architect each came forward to be sworn in and review the request. Mr. <br />Mowchan reviewed that the addition is to provide a handi cap accessible kitchen, bathroom, and laundry <br />room for their elderly parents. Discussion regarding the existing power lines being effected by the addition <br />took place. The building Commissioner advised that it was not uncommon to have CEI wires redirected, <br />but believed that the party building the addition is responsible to pay any fees; which may be involved. The <br />applicant advised that the fee to move the lines had already been calculated into the costs to build the <br />addition. <br />W. Kremzar motion to grant Joseph & Maria Mowchan of (PP#234-25-114), 5790 Park Ridge Drive <br />their request for variance (1123.12), wluch consists of an addifion to their home and that the <br />following variance is granted; <br />1. A 4-foot variance for rear yard requirements, (code requires 50 ft., applicant shows, 46 ft.). <br />Which as in violation of Ord. 90-125 section (1135.08 (A)). Variance Granted <br />3. IDavid Chalkwater; (PP# 235-01-055), 5122 Andrus Ave: (WRD3) <br />Request for variance (1123.12). The proposal consists of an addition. <br />A special permit to add to a non-conforming building (1165.02). <br />The following variances are requested: <br />1. A 2 foot variance for side yard setback requirements, (code requires 5', applicant shows 3'), section <br />(1135.07 (A)). <br />2. A 1 foot variance for two side yards totaling less than 20 feet, (code requires 20', applicant shows 19'), <br />section (1135.07 (A)). <br />Which is in violation of Ord. 90-125 sections (1165.02) and (1135.07 (A)). <br />Chairman Maloney called all interested parties forvvard to review the request. Mr. Chalkwater the owner, <br />and Ms. Clausing, a neighbor each came forward to be swom in and review the request. Mr. Chalkwater <br />reviewed that he would like to extend the side of his house outward 5-feet, extend the back of the home <br />outward 4-feet and add a second story to his home. However, they may not need to expand the rear of the <br />home the additional4-feet. The neighbor thought it was an additional building, but now understands and has <br />no objections. The applicant questioned if he would require additional variances if a landing is added to the <br />front steps when they are replaced. Building Commissioner Conway advised that as long as the applicant did <br />not place a roof over the porch or steps additional variances would not be required. <br />N. Sergi motion to grant David Chalkwater of (PP# 235-01-055), 5122 Andrus Ave. his request for <br />variance (1123.12) which consists of an addition to the existing home and that the following variances <br />and a special permit to add to a non-conforaning building, section (1165.02) are granted: <br />1. A 2 foot variance ffor side yard setback requirements, (code requires 5', applicant shows 3'), <br />section (1135.07 (A)). <br />2. A 1 foot variance for two side yards totaling less than 20 feet, (code requires 20', applicant shows <br />19'), sechon (1135.07 (A)). <br />Which is in violation of Ord. 90-125 sec9ions (1165.02) and (1135.07 (A)). W. Kremzar seconded the <br />motion, which was unanimously approved. Variances Granted <br />4. Kathv Federer; (PP# 232-26-024), 4765 Carsten Lane: (VVItD1) <br />Request for variance (1123.12). The proposal consists of a shed. <br />The following variances are requested: <br />1. A 40 square foot variance for shed exceeding 2% of rear yard area, (code permits 80 sq ft, applicant <br />shows 120 sq ft), section (1135.02 (D) (1)). <br />2. A 5 foot variance for rear lot line location, (code requires 10', applicant shows 5'), section (1135.02 (D) <br />(4). <br />Which is in violation of Ord. 90-125 sections (1135.02 (D) (1)) and section (1135.02 (D) (4). <br />2
