Minutes of a Meeting of the North Olmsted Parks & Recreation Commission <br />October 3, 2005 <br /> <br /> <br />He would like it to match the way everything else looked, but it was hard enough finding $22,000 <br />and the time frame. Mr. Kelley asked if, when the work will be done, the pool would be drained. <br />st <br />Mr. Limpert said that it’s expected to be drained. If it’s done by November 1, there will be time <br />to refill the pool for swim team practice. <br /> <br />This concluded the Report of the Safety Director <br /> <br />OLD BUSINESS <br /> <br />Fence at Ball Park <br /> <br />Mr. Baxter said that, at the end of the last meeting, Randi (Jones) asked the question about how <br />we erected the fence that’s on Diamond #2 when the Commission never discussed it. How did <br />that happen? Mr. Limpert said that it was his recollection that the first part of the fence on <br />Diamond #2 was not discussed by Council, but he believed was discussed in a Rec Commission <br />meeting, if that rings any bells. Mr. Kelley said that he made a statement in the last meeting where <br />Mr. Murphy asked him a question about how that happened. Mr. Kelley said that he believed that <br />they did come here to the Commission and asked that they encapsulate the whole diamond. The <br />Chairman went back home, checked the record, and found that they did NOT come to the <br />Commission. They came when Claire Hayes was still Chair of this Commission and asked to put <br />a fence up east to west just for safety. That’s all that came here. Nothing was talked about past <br />that point. Go down there now, and it’s completely enclosed in. Mr. Limpert said it was brought <br />to his attention the first week in his job as Safety Director, asking what it was to take to get it <br />done. The Safety Director tried in that brief meeting to let them know that they were going to <br />have to run it through the Rec Commission; they would have to get it through Council if it were <br />necessary. There was not enough due diligence done on the prior fence; that is why Mr. Limpert <br />wanted to throw in as much as possible on this one. Mr. Baxter said that the softball association, <br />comprised mostly of non-residents, just went ahead and did it. Mr. Limpert said that the decision <br />was made by the Rec Department when the money was donated to move forward, and he did not <br />think it went through all that it should have gone through. Not that it was prescribed what had to <br />be done; he thought more should have been done. Mr. DiSalvo said that he knows it’s necessary <br />to have a fence permitted, so the Building Department must have some record of it, and it had to <br />go through Safety. There is no way to build a fence without it being permitted. The <br />Commissioner said he checked the minutes as well and did not find anything regarding it for the <br />last three years. Mr. Kelley asked if the City can take the fence down now. (Overlapping <br />conversation). Mr. Miller was asked his recollection. He said that the Rec Department should <br />talk to the people who erected the fence; where did they get their authority to put it in and their <br />position on the matter. After the high school fence, Mr. Miller felt that the issue should be run <br />through the Law Department to see whether there is a need for corresponding legislation or not; <br />whether they need to simply go through the Building Department. This has been a touchy issue <br />that has been left unanswered, and maybe unanswered implies that there is some consent for <br />advertising. If the Law Department says it’s fine, this Commission has the authority; it needs to <br />go no further. He asked that Mr. Barker keep Council informed re status of <br />Page 8 <br /> <br />
