Minutes of a Meeting of the North Olmsted Parks & Recreation Commission <br />October 3, 2005 <br /> <br />as prints and plans, and the Rec will try to accommodate them as best it can if it seems reasonable. <br /> <br />Mr. DiSalvo asked about the tree. Mr. Limpert said that he did not have a chance to talk with the <br />Forester but is waiting to see what the schools draw up. <br /> <br />HVAC Units <br /> <br />The contract for the HVAC Units for tennis was given to LK Heating; they have been told to <br />proceed upon receiving a competitive bid. There is a small glitch: the contract was issued to <br />L&K Heating; it’s LK Heating; this will be rectified. <br /> <br />Mr. Miller asked Mr. Limpert that on both the pool roof and the LK contracts if there were <br />completion dates. Mr. Limpert said that, in the contract, the pool roof is to be done by November <br />1, 2005. Mr. Miller asked if LK Heating had a completion date; Mr. Limpert responded no there <br />is not, but they just got the contract last week. Mr. Miller asked if the contract says they have to <br />start within thirty days of signing. Mr. Limpert said he did not know if that was or was not in the <br />contract; he knew that LK is anxious to get started. There are about ten days to get the units. <br />Mr. Miller asked if the Law Department reviewed the contracts. Mr. Limpert said that yes, the <br />Law Department reviewed both the contracts. In fact, the Law Department wrote the one for the <br />pool roof. Mr. Miller said that, just to be aware, he has seen different contracts, and it seemed to <br />him that there ought to be an agreed-upon start date and an agreed-upon finish date. As far as <br />penalties, certainly here there is a question of enforcement of failure to fulfill the contract, but <br />that’s not benefiting anybody. If the City doesn’t have start and completion dates, there is a <br />contractor dictating when the job’s going to get done. That’s not the way business is done. <br />These issues need to be controlled. The Law Department agreed with Mr. Miller that they would <br />pursue that more aggressively. Mr. Limpert said that one of the things that is a challenge is that <br />cities tend to be difficult in wanting all these contracts, it’s hard to get people. For example, on <br />the HVAC units for the tennis courts, we had five companies take out bid packages; only one <br />returned it. Fortunately, they were within ten percent of the amount that was projected, so it was <br />able to be moved forward. The same thing happened on the radios for the fire department and, <br />again, at least four people took out bid packages; one returned it. As much as we can say that we <br />really want to get all this so we have it, we don’t get the responses that way. <br /> <br />Pool Beam <br /> <br />Mr. Kelley asked about the beam over the pool: each of the beams has four sections. The beam <br />that’s being talked about is the third beam from the door from east to west, second section. Is <br />that the only one planned on being corrected? Mr. Limpert said that was the only one that would <br />be beefed up because it was damaged during the roof construction. Mr. Kelley said that the fix on <br />that is to weld gussets and to encapsulate the section. Mr. Limpert said that it would be pulled to <br />bring it back to plumb; then there will be gussets welded and encapsulation on the one arm. <br />Page 7 <br /> <br />
