BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF DECEMBER 3, 2018 <br />ROLL CALL <br />Chairman Raig called the meeting to order at 7:00 pm in Council Chambers and led the Pledge <br />of Allegiance. <br />Present: Mike Raig, Eric Allain, Bob Papotto, Ralph Mackey, Dan Rahm <br />Staff: Assistant Law Director Bryan O'Malley, Assistant Building Commissioner Dan Russell, <br />Planner James Aspery, Administrative Assistant Nicole Rambo -Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Allain moved, seconded by Mr. Papotto, to approve the Building and Zoning Board of <br />Appeals minutes of November 5, 2018, motion passed 4-0, Mr. Allain abstained. <br />RESIDENTIAL APPEALS AND REQUESTS <br />18-12532; Timothy Ulewicz; 26775 Butternut Ridae Road <br />Representative: Tim Ulewicz, owner <br />Proposals consists of a detached garage and an appeal of a Notice of Violation. Property is zoned <br />A -One Family Residence. <br />1. A 330 sq. ft. variance for total area of garages; code permits 750 sq. ft., applicant shows <br />1,080 sq. ft.; Section 1135.02(B)(1)(a). <br />2. An 8 ft. 6 in. variance for detached garage height; code permits 15 ft., applicant shows 24 ft. <br />6 in.; Section 1135.02(B)(1)(b). Note: Building height is determined from the average <br />elevation of the finished grade at the front of the building to the average height between the <br />eaves and ridge line for a gable, hip or gambrel roof. <br />3. A 1 ft. 6 in. variance for rear building setback; code requires 10 ft., applicant shows 8 ft. 6 <br />in.; Section 1135.02(B)(1)(c). <br />4. A variance for a gravel driveway and parking pad; code requires that driveways and parking <br />pads are constructed of cement or asphalt, applicant shows the driveway serving the new <br />garage to be gravel; Section 1135.02(B)(2)(b). <br />5. An appeal of a Notice of Violation for the location of firewood which is closer than 5 ft. to <br />the side property line per Section 1363.302.13(a). <br />6. An appeal of a Notice of Violation for the condition of the gravel driveway which has <br />deteriorated and is overgrown with weeds per Section 1363.302.8. <br />Mr. Aspery stated that the applicant is proposing to construct a new detached garage in the <br />southwest corner of the property. The property currently has two existing accessory structures, <br />both of which are classified as sheds, and the applicant is proposing to combine the structures to <br />create a two-story garage by adding on to the existing structures. The proposed structure would <br />be 24 feet by 45 feet for a total area of 1,080 square feet, requiring a variance of 330 square feet <br />for total garage area. The proposed height of 24 feet 6 inches requires a variance of 8 feet 6 <br />inches. The building height is determined from the average elevation of the finished grade at the <br />
