/ - <br />NORTH OLMSTED CIVIL SERVICE COMMISSION <br />INFORMAL SPECIAL MEETING - OCTOBER 15, 1986 <br />Attending: Patricia Bahas, Robert Wendt, Chairman, Mark.Musial, Peg Hill, <br />Secretary. <br />Also present Flash Fairfield,'W6stlife correspondent. <br />Mr. Wendt confirmed with Pat Bahas the date for the Police Agility <br />Test scheduled for Saturday- November 1, 1986 at the high school. <br />Mr. Musial was concerned about a phone call he received inquiring <br />if a person would be disqualified from taking the test if they had <br />a felony record. Mrs. Bahas answering the question stated - if the <br />person stated on the application she or he had a felony record as <br />an adult - it would be up to the hiring authority, but they would <br />be granted an interview. However, if such a record existed as a <br />juvenile then we would have no right to ask the question. <br />Mr. Musial presented and read his letter going to Mr.'Levine of the <br />State Board of Personnel Review. This letter was an answer to a <br />letter requesting an investigation into the Carol Ward vs City of <br />North Olmsted case. (Letter and Legal Opinion by Michael Gareau <br />in file.) His feeling was the Commission did not have jurisdiction <br />over this matter, however, did state in the letter that the Com- <br />mission was split in this decision - two voting not to hold a <br />hearing and one voting to have a hearing. <br />Mrs. Bahas quoted from the Civil Service -rules with respect to hiring <br />within the city, example; clerk's job, showing that the department <br />heads do the hiring and firings are done on the.basis of the employees <br />evaluation. Discussion ensued with regard to appointing authority. <br />Mrs. Bahas read her letter going to the State Board, which will be an <br />addendum to Mr. Musial's letter. <br />Mrs. Bahas stated her main concern was a definition of the words "re- <br />assignment" and "transfer". A clarification is needed now to effect <br />any future cases coming before the Commission. This would also determine <br />whetheror not we, the Commission, had the right to hear such cases. <br />Both Mr. Wendt and Mr. Musial agreed that a clear definition should <br />be made.
