CITY OF NORTH OLMSTED <br />CIVIL SERVICE COMMISSION <br />NORTI4 OLMSTM, 01410 <br />REGULAR MEETING OF THE CIVIL SERVICE COMMISSION - <br />DECEMBER 18, 19V& <br />Present: Commissioners: Patricia Bahas, Robert Wendt, Thomas Stroh and <br />Secretary, Peg Hill. <br />Also present: Mr. James Kline, Mr. Ernest Cummings, North Olmsted City Schools. <br />First portion of this meeting was to clarify the classification of the North Olmsted <br />City School Head Cook and Asst, Head Cook. Mr. Kline, Director of Personnel and <br />Mr. Ernest Cummings were present for questions and answers regarding these classi- <br />fications. The Commission resolved to: 1) that the positions will be covered by <br />Civil Service in a non-competitive capacity. Letter will be forwarded to Mr. Kline <br />regarding this finding and also a request that he forward to the commission the <br />"old" and "new"copies of the Job Descriptions covering these positions. <br />Also discussed was the forthcoming Secretary I test for the North Olmsted City <br />Schools. The commission resolved to: 2) hold the Secretary I test as soon after <br />the first of the new year as possible. <br />Second portion of this meeting was a Hearing: City of North Olmsted vs. Michael- <br />angelo Butera showing cause for dismissal of Patrolman Butera on four (4) counts <br />of violation of ethics. <br />In need of more space the meeting was moved.to City Hall Council Chambers to <br />accomodate the needs of the attorneys, witnesses, reporters and guests. <br />Present at this Hearing: Mr. Michael Gareau, Mr. Neal Jamison, Mr. Michael Butera, <br />Police Officers, Flynn, Metzger, Krynak, Chief Marsh, Capt. Sefcek and various, <br />other member of the Department. Also present two Police Dispatchers, and the <br />Court Reporter. <br />Opening statements by Law Director Gareau surrounding the fact that this hearing will <br />prove an attempt was made to fix a ticket and this is in violation of rules of the <br />City of North Olmsted Police Department and rules of the oath of office and is of <br />such serious magnitude that the recommendation of Chief Marsh for dismissal, with <br />concurrence of Safety Director, should be upheld also with the Civil Service Commission. <br />Attorney Jamison in his opening statement, following those of the Law Director, stated <br />that it was not clear that there was a request to fix a ticket in this case,.but <br />basically it was a difference of opinion of the substance of the conversation between <br />two people, Officers Flynn and Butera. <br />Attorney Jamison further stated that the punishment of dismissal in this case is unjusti- <br />fied and unwarrented. <br />Officer Flynn was called to verify his written statements and to relate the incidents <br />that occurred the evening of October 7, 1986. (Statements are a matter of record held <br />in the Civil Service office.) <br />Witnesses called upon at this meeting: Lt. Metzger, Capt. Krynak, Police Dispatchers: <br />Kort and Bethke. <br />This meeting was adjourned at 10:34 P.M. to be continued at a special meeting to be <br />held December 30, 1986 for continuation of the Hearing. <br />
