CIVIL'SERVICE MEETING - DECEMBER 18, 1986 Page #1 <br />Meeting called to order at 7:50 P.M. <br />Civil Service Commissioners present: Pat Bahas, Tom Stroh, Robert Wendt. <br />Meeting recorded by Peg Hill, Secretary. <br />First portion of the meeting was to clarify the classification of the North <br />Olmsted City School Head Cook and Asst. Head Cook. Mr. James Kline, Director <br />of Personnel and Mr. Ernest Cummings, President of OAPSE were present at this <br />meeting. Also to be discussed was the forthcoming Secretary I test. <br />The commission resolved to: 1) hold a Secretary I test shorthly after the <br />first of the year and 2) that the positions of Head Cook and Asst. Head Cook <br />will be covered by Civil Service in a non-competitive capacity. Letters will <br />be forwarded to.Mr. Kline regarding this finding and also a request that the <br />board forward to us "old" and "new" copies of the job descriptions covering <br />these positions. <br />Second portion of the Civil Service meeting was a Hearing: Patrolman Michael <br />Butera/City of North Olmsted Police Department = showing cause for dismissal <br />of Patrolman Butera. <br />Present: Police Chief.Marsh, Capt. Sefcek, Lieut Metzger, Capt. Krynak, <br />Patrolman, Robert Flynn, various other police officers, two Police Dispatchers. <br />Mr. Michael Gareau, Law Director, Neil Jamison, Attorney representing Patrolman <br />Butera, along with department representatives for the City. <br />This portion of the meeting adjourned at the Town Hall and resumed again at <br />the City Hall Council area for needed space. <br />Opening statements presented by Law Director Gareau surrounding the fact that <br />this -Hearing will prove that there was an attempt made to "fix" a ticket, and <br />that this attempt is in violation of the rules of the City of North Olmsted <br />Police Department and the rules of the oath of office and it is of such a <br />serious magnitude that the recommendation of the Chief for dismissal and the <br />concurrence by the Safety Director and should be upheld by the Civil Service <br />Commission ... <br />Attorney Jamison in his openingostatement, folapwing the Law Director, stated <br />that it was not clear that there was a fixing of a ticket in this case, but <br />basically it was a difference in opinion of the substance in a conversation <br />between two people,'Patrolmen Butera and Flynn... <br />Attorney feels that the punishment of a dismissal of an officer in this case <br />is unjustified and unwarrented especially since in the past in this department <br />similar type behavior has not gone even to this level in terms of discipline... <br />Furthermore, if you look at Officer Butera's personal record over the the last <br />three and one-half years, both his personal life and his professional life, <br />the Commission will see that termination is unwarrented in this case - he's <br />a good officer and is an asset to this community. <br />Law Director Gareau called as a witness Officer Flynn and the officer was sworn <br />in by commissioner Stroh. <br />Officer Flynn stated.he was.a North Olmsted Police Department Patrolman for nine <br />years, and proceeded to relate:the-incident.:occurring.on.,October 71Y 1986. <br />Under questioning he -stated he was on :general patrol. duties that shift, from <br />8:00 P..M.'to 4:00 A.M.:and visiting,r.the Buckeye_ Bowling Alley for regular patrol <br />duties,.the time being'about.8:55'P.M. Upon entering the parking lot of the <br />bowling alley he found that two automobiles parked in the fire lane.. Flynn stated he issued im.fire lane parking <br />violation citation to each of the two vehicles, and this parking violation became <br />Exhibit #2. <br />
