~ CIVIL SERVICE MEETING - DECEMBER 18, 1986 Page #2 <br />Commissioner Bahas questioned regarding the location of the fire lane posts and <br />asked where the posts would be... <br />Explanation ensued surrounding the location of the signs on the building and independent <br />of the building. <br />Upon questioning Flynn related that the car did not appear to be disabled—and that the <br />hood was not "up"... there was nothing unusual about the car other than it was parked <br />in a no parking area. <br />Officer Flynn resumed his normal patrol until the time he received a communication <br />from the dispatch... explaining he received a call from Dispatcher, Christine Kort, <br />who requested he go to a pay phone and give her that phone number.. no reason was <br />given. Flynn then went to a pay phone and radioed in the phone number. As a result <br />of this call he received a phone call on the pay phone from Patrolman Butera. <br />Patrolman Flynn was asked on this call if he had been at the Buckeye Lanes and if <br />he had issued a parking citation—and, if one of them had been to a silver grey'LeCar <br />He was asked where that car had been parked and Butera acknowledged that obviously <br />it was in a fire lane... <br />Patrolman Butera then stated that the reason he called was this "I was talking to <br />a friend of mine, who is almost like a brother, a very dear friendwand in this <br />conversation with his friend he mentioned that (the friend) - had received a <br />parking citation at the Buckeye Lanes, but the friend had not called about the <br />parking ticket, but that topic did come up..what Patrolman Butera was wondering <br />was "can we call it disabled and I write it up that way", <br />When this question was asked Patrolman Flynn answered "you're talking to the wrong <br />guy - if you want to talk to my shift sergeant or the shift lieutenant and they <br />direct me to void the ticket that would be fine but I won't void the ticket:. <br />Law Director Gareau questioned Flynn on what would be necessary to void the ticket.. <br />Answering Flynn stated that whenever they do void a ticket it requires a departmental <br />procedure... <br />Patrolman Flynn stated that it was his opinion that this car was not disabled. <br />Law Director asked how Flynn would characterize the request of Officer Butera. <br />Flynn replied "extremely unusual". In Flynn's opinion he was being asked to do <br />something illegal which was to falsify a signed police form... <br />Flynn related that later, after the phone call, and resuming his patrol he wondered <br />about the car at the Buckeye Lanes,as to whether or not it was disabled�so he drove <br />back to the Buckeye Lanes at about 9:50 P.M. and the car was not there. His thinking <br />at the time was one of disbelief that he would be asked such a request would be made <br />of him and he felt obligated to inform his shift supervisor of the entire incident. .. <br />Patrolman Flynn stated that after midnight about 1:00 A.M. he had the occasion to see <br />his shift supervisor on the road and asked the supervisor if I could talk to him <br />somewhere, we met, and I informed him of the entire incident... <br />Law Director Gareau questioned if Patrolman Flynn was required to do anything else <br />after reported this incident. Flynn answered on the next shift he worked on October <br />8th Lieutenant Metzger informed him to type up a statement regarding the entire <br />incident, turn it into him, and from that point he would -handle the matter... <br />Patrolman Flynn then typed .up the statement. <br />After this initial statement Flynn was requested to come into the department an hour <br />earlier one day to give a verbal statement to Sgt. -Mason, which was also typed up at <br />that time. <br />Patrolman Flynn ended his statements.in answer to questioning=, of Law Director. <br />Attorney Jamison stated to the Commission that h.6 had never received any paper work } <br />surrounding the statement referred to by: Patrolman Flynn and utas-,assured.he woul&. <br />receive all` necessary papers before"'the next:;meeting of:�.the Commission <br />Attorney Jamison asked Patrolman'Tlynn to,identify his Supplementar_X Invest _.Report <br />signed by him as a matter of record. This. was then introduced as'�Exhlbit Ay dated 10/9/86. <br />Questioning of Patrolman Flynn continued by Attorney Jamison.. <br />Jamison pointed out the Internal'Investigation dated:October 155, 1986and.ask.ed Flynn to <br />view it. This report was introduced as Exhibit B. <br />
