Mr. Thomay questioned if Dr. Green saw the Civil Service vision requirements. <br />Mr. Stein indicated he took all the documents to the doctor for review including the entry-level <br />application requirement. Mr. Stein suggested that the only test Dr. Hershner gave him was a <br />pseudoisochromatic test plate. He did no other color vision testing and never gave a screening <br />referral. Mr. Stein suggested that Dr. Hershner believed that the Civil Service color vision <br />requirements was either a pass or fail only. Mr. Stein believes that he meets the city <br />requirements as he has anomalous trichromacy. Mr. Thomay questioned if the applicant could <br />distinguish the colors of a traffic light. Mr. Stein commented that he has not had any trouble <br />with traffic lights. He submitted a letter from the fire station he volunteers at now for the board <br />to review. Mr. Thomay asked that the documents be marked as exhibits and copied. Mr. Stein <br />indicated that Dr. Hershner suggested that he have further tests done at Ohio Medical Center, <br />but never put it in writing. Mr. Thomay questioned Fire Chief Bak if in his opinion, the red and <br />green deficiency would be a problem. Fire Chief Bak suggested that he could not think of <br />anything off hand. Mr. Dubelko suggested that the code is written in general terms and the <br />Commission has to interpret its rule. It is good that the Commission is receiving input from <br />everyone with respect to why this is important. The Commission can apply some common sense <br />in determining whether or not this applicant meets the Civil Service vision standards. If the <br />candidate does not meet the standard, then he should be disqualified and removed from the list. <br />On the other hand, the Commission has to determine what the standard is and whether or not <br />with all the documentation this candidate has presented, is it enough evidence to show the <br />Commission he should not be disqualified. If the board feels that they do not have enough <br />information or are just not sure, then the board can continue the hearing and request additional <br />information. Mr. Farrell suggested that Mr. Stein has taken the extra step by going to Ohio <br />State to have the tests done and Dr. Green indicates in her letter that Mr. Stein does meet our <br />criteria. He suggested Mr. Stein have Dr. Green send a copy of the tests and the letter to Dr. <br />Hershner and let him review all the new findings and render an opinion. Mr. Thomay indicated <br />that he agreed with Mr. Farrell's idea. Fire Chief Bak questioned if the hearing would have to <br />be tabled until the next regular meeting. Mr. Thomay suggested that the board would be calling <br />a special meeting to certify the police written test results and Dr. Hershner's findings could be <br />addressed at that time. Mr. Stein indicated that he tried to take Dr. Green's findings to Dr. <br />Hershner but he is on vacation for a week. Mr. Farrell suggested having any of the Doctors in <br />the practice review all the documents for an opinion. Mr. Thomay felt that Dr. Hershner who <br />did the first test should review the results and render an opinion. Fire Chief Bak commented <br />that there has been a lot of time and money put into filling this opening and his department is <br />encoring a lot of overtime. He would like to have this issue settled one way or the other as soon <br />as possible. He would like to see the board accept an opinion from any of the doctors in the <br />practice. Mr. Dubelko indicated that the board could continue the hearing at a special meeting if <br />they are not ready to render an opinion tonight. Mr. Farrell believed that any of the doctors in <br />the practice could render an opinion. Mr. Thomay instructed the clerk to contact the Eye Center <br />to receive an opinion from any of the eye doctors there and once the opinion is received, contact <br />all the board members to set up a special meeting. Mr. Thomay questioned if Mr. Stein was <br />available during the day. Mr. Stein indicated that he was available during the day. <br />P. Farrell motioned to recess the hearing until an opinion is received from the Eye Centers <br />office. The motion was seconded by J. Thomay and unanimously approved.
