are procedural problems, which would be difficult to deal with short of obtaining "waivers" from all <br />the candidates. Mr. Thomay questioned if the commission truly needed to make a motion on <br />dropping a book because their motion was to allow the Fire Chief and Safety Director to pick which <br />books would be used for the test. Mrs. Rote voiced that the motion to remove the book should be <br />made to make sure there is no protests. Mr. Thomay indicated the commission needs to motion to <br />have 4 study books instead of 5 study books. <br />I Thomay motioned to drop the Building Construction for the Fire Services, 3rd edition, 1992 <br />and use only the remaining 4 books as the research material for the written test. R. Giesser <br />seconded the motion, which was unanimously approved. <br />2. Mr. Thomay indicated that a City worker was present as he had questions regarding who is and is <br />not covered by Civil Service. He asked the gentleman to introduce himself. Bob Binggeli, Sanitary <br />Systems Supervisor for the City of North Olmsted. Mr. Thomay invited Mr. Binggeli to voice his <br />question. Mr. Binggeli indicated that he would like to know if Civil Service covers his position or <br />not. Mr. Thomay questioned if Mr. Binggeli ever received anything when he was hired stating that <br />he was part of Civil Service. Mr. Binggeli reviewed that when he was first hired in the city it was a <br />Union position that he was hired for. He left the union to take a position as foreman and the person <br />I replaced always stated he was Civil Service and had a letter stating the fact. Mr. Thomay <br />questioned what period that was. Mr. Binggeli thought it was fifteen years ago about 1986 as that <br />is when he became a foreman. Since then, he has been promoted to Sanitary Systems Supervisor, <br />which was 8 years ago. Mr. Thomay questioned if the Secretary had any reason to believe there <br />could be a question regarding the position. Mrs. Rote suggested that in the Codified Ordinances of <br />the City of North Olmsted Ohio, Article VI section (3) it states that the Civil service Commission <br />shall be divided into classified, and unclassified service. The unclassified list does not include Mr. <br />Binggeli's position or a few other positions within the city. The Charter further states that classified <br />service shall comprise all positions not specifically included in this charter in the Unclassified <br />Service. As Mr. Binggeli's position as well as other positions within the city is not listed, I <br />suggested that he attend the Civil Service meeting and address the Commission with his question. <br />Mr. Thomay indicated that the commission needed to look into the matter. He directed the <br />secretary to go back to old minutes when Unions first came in and check employees that may have <br />letters stating they are in the Civil Service. Mrs. Rote suggested that the codified stipulate <br />positions not individuals being covered or not. Mr. Binggeli suggested that he is in different local <br />organizations with communities that surround ours and many those members has stated that they are <br />Civil Service and they never took a test. Mrs. Giesser questioned if Mr. Bob Gillcrest was still alive <br />and in the area. Mr. Binggeli suggested he could speak with his son as Bob just had triple by-pass <br />surgery. Mrs. Rote suggested looking into Mr. Gillcrest's personal file as well as all the other <br />positions in questions to see if any of the employees received letters from Civil Service stating their <br />position was protected by Civil Service. She suggested that the reason the Recreation maintenance <br />foreman's name is on the Civil Service list is because Tom Stein submitted a copy of a letter he <br />received from the Civil Service. She hoped that if Civil Service gave letters to employees stating <br />they were in Civil Service a copy of the letter should have been placed in their personal records. <br />Mr. Thomay suggesting getting the date off of Mr. Stein's letter to start looking for motion to send <br />letters. Mrs. Giesser directed the secretary to get a list of every position within the city so the Civil <br />Service can address this issue. Mr. Binggeli suggested that there has been positions added as well <br />as dropped that may have been covered by Civil Service according to the charter. Mrs. Rote voiced <br />that the commission has touched on this subject in the past but nothing was settled. <br />3. Mrs. Rote indicated that the pre-test orientation meeting date was moved from May 26,2003 to <br />May 27, 2003 to accommodate the holiday she questioned if the commission needed to make a <br />2 <br />
