t .. <br />CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE!" <br />CIVIL SERVICE COMMISSION MEETING <br />MINUTES — JULY 21, 2003 <br />COUNCIL'S CAUCUS ROOM <br />7:00 P.M. <br />ROLL CALL: <br />Chairman J. Thomay called the meeting to order at 7:00 p.m. <br />PRESENT: Chairman J. Thomay and Board Member R. Giesser <br />ALSO PRESENT: Assistant Law Director Bryan O'Malley, Safety Director Jesse, and Fire Chief <br />Klecan. <br />H. DISPOSITION OF MINUTES: <br />The Civil Service minutes dated June 23, 2003 are submitted for approval <br />Mr. O'Malley commented that he would like to voice a concern about the minutes. He suggested <br />that the sentence on page 2 (Mr. O'Malley advised that the question of who is classified and un- <br />classified should probably be a question directed to the Law Director for an answer). Set a tone in <br />the minutes that does not give an accurate reflection of the discussion that took place. He believes <br />the advice that was being provided to the commission was that the commission should seek the <br />advice of the law department as to it's roll and for guidance's to performing their role, as opposed <br />to the Law Director determining who is and is not classified. The point that he was trying to make <br />throughout many sections of the meeting was that the commission is advised to seek its legal <br />guidance from the Law Director. Ms. Giesser indicated that she did not have a problem with the <br />sentence "nor" did she have a problem with the understanding Mr. O'Malley is giving to the <br />context of the discussion. She believes Mr. O'Malley was saying we the Commissioners will make <br />the ultimate decision. However, in terms of how the commission goes about it and how the <br />framing of the decision is we should seek our guidance from the Law Director. Mr. O'Malley <br />agreed that that was an accurate interpretation. He commented that the minutes are the records of <br />the Civil Service Commission. It is for the Civil Service Commission to determine for itself <br />whether the minutes are a fair and accurate representation of the course of the dialogue or how <br />they are presented. Mr. Thomay indicated that the commission would move forward. <br />J. Thomay motion to approve the minutes as written. R. Giesser seconded the motion, which <br />was unanimously approved. <br />III. CORRESPONDENCE: <br />There were (16) pieces of correspondence received and (3) pieces of correspondence sent out <br />Mr. Thomay voiced that he received a copy of the e-mail regarding the testing site and was <br />concerned with the comments from the union local. It indicates that people were going in and out <br />of the exam room. He questioned what time the meeting took place. Mrs. Rote indicated that the <br />written exam took place on Tuesday, July 8, 2003, at 5:30 p.m. Mr. Thomay questioned if the <br />first shift of the day was still on duty. Mrs. Rote indicated the day shift ended at 3:30 p.m. <br />however there was a second shift on duty. Mr. Thomay indicated that the letter states there were <br />people going in and out of the exam room to use the restroom while the test was being conducted. <br />Furthermore, there were people entering the break room to check and work on the PA system. <br />
