CITY OF NORTH OLMSTED <br />CIVIL SERVICE COMMISSION MEETING <br />MAYOR'S CONFERENCE ROOM <br />MINUTES - MAY 169 2005 <br />7:00 P.M. <br />I. ROLL CALL: Chairperson Giesser called the meeting to order at 7:10 p.m. <br />PRESENT: Chairperson R. Giesser, W. Hohmann, and M. Ubaldi <br />ALSO PRESENT: Assistant Law Director B. O'Malley (present for the beginning of the <br />meeting), and Civil Service Secretary A. Kilbane <br />Mrs. Giesser suggested the Commission address old business first since Mr. Bingelli was present. <br />II. DISPOSITION OF MINUTES: <br />Mrs. Giesser said before moving on, she would like to officially enter in the record, the <br />Commission's congratulations to Annie Kilbane on her appointment as the Mayor's secretary. <br />The Civil Service minutes dated April 18, 2005 have been submitted for approval. <br />R. Giesser made a motion to accept the minutes as submitted. The motion was seconded by <br />M. Ubaldi and unanimously approved. <br />III. COMMUNICATIONS: <br />There were 7 items of correspondence received and 5 items of correspondence sent out by the <br />Civil Service Commission. <br />Mr. O'Malley inquired about the candidates requesting removal from the fire fighter eligibility <br />list. He asked if they are among the top candidates on the list. Mrs. Kilbane indicated the <br />candidates are all near the top. She said the Assistant Chief informed her that one of the <br />candidates got a job elsewhere and therefore was requesting removal from the list. Mrs. Giesser <br />said the commission sent over 5 names, and she now wonders if the Commission has to take <br />action. She said if one of those removals was in the top five, she would like to know if they have <br />to do anything to get that new fifth person over to the fire department. Mr. O'Malley said yes, he <br />does not believe it is automatic. He thinks they get a list of five and they have to work from that <br />list of five. He does not believe they can cycle through and toss one back. Mrs. Giesser asked if <br />the department works with a list of four names once a name is removed. Mr. Hohmann said he <br />would think the Chief would want at least five names. Mr. O'Malley said he does not think the <br />Chief can get another name unless the Commission sends it to him. Mrs. Giesser asked Mrs. <br />Kilbane to find if any of the candidates requesting removal from the eligibility list are in the top <br />five. Mrs. Kilbane informed the Commission that the fire department has already received the <br />next five names on the list and in fact they hired a fire fighter in March. Mr. O'Malley said the <br />department should have reported that back to the Commission. Mrs. Giesser reviewed the <br />procedure for passing over candidates. She said the only way the Chief can remove a name other <br />than it being passed over three, times is to go before the Commission with just cause. Mr. <br />Hohmann said his concern is "just cause" is not clearly defined. Mrs. Giesser explained the <br />process further and indicated that once a matter is brought to the Commission, it becomes public <br />record. Mr. O'Malley said if one of the five candidates from a list is removed, a call is made to <br />the Civil Service office to request another name. Mrs. Giesser asked Mr. O'Malley to look into <br />the process further before the next meeting. She would like to know if, once a name is removed or <br />an appointment made, the Commission has to certify the next name to the Chief. She added she <br />
