there is any confusion on what has been adopted in Rule III, Mrs. Kilbane can fax over a draft and <br />she can provide clarification. Mrs. Giesser asked Mrs. Kilbane if she was able to find out about <br />what documentation is released from testing companies once a, protest is filed. Mrs. Kilbane <br />indicated she spoke with Pat Ramsey who conducted the most recent test and Mrs. Ramsey <br />indicated it is only a keyed test and an answer sheet that is released. She said Mrs. Ramsey added <br />that most cities do it that way, but it depends on the rules for each city. Mrs. Giesser brought up <br />the previous protest involving the fire department. A discussion ensued involving Section 124.45 <br />of the Ohio Revised Code. Mrs. Giesser said they can either put explicit language in their rules or <br />simply say "the procedure will be in accordance with the Ohio Revised Code," and refer to <br />whatever section applies. She added there are two issues, the first being compliance with the state <br />code. She said they do not have any real interest in doing it "their" way other than the five day <br />period being a hectic time for the Commission. Mr. Ubaldi asked if they would be in conflict with <br />the code if they gave applicants more time. Mr. Hohmann said it could be a problem with other <br />applicants. Mrs. Giesser said the second issue is if they want to stick with code, she wonders if <br />they should write the code specifically in the rules or just refer to the applicable section of the <br />Ohio Revised Code. Mr. Hohmann mentioned if the state changes the code, they would be bound <br />to change the rules if the language is specific. <br />V. NEW BUSINESS: <br />Address requests to remove candidate names from the fire fighter eligibility list <br />Mrs. Giesser said her recollection is that when a request comes in for removal of a name, the <br />Commission would make a motion to accept the request. Mrs. Kilbane indicated the Commission <br />had asked to get a monthly report and it did in fact motion on a removal at the last meeting. <br />R. Giesser made a motion to acknowledge receipt of requests from Brandon Cole, Kenneth <br />Kulczycki, and Russell Hageman to have their names removed from the fire fighter <br />eligibility list. The Commission accepts the requests. The motion was seconded by M. <br />Ubaldi and unanimously approved. <br />VI. ADJOURNMENT: M. Ubaldi made a motion to adjourn. The motion was seconded by W. <br />Hohmann and unanimously approved.
