Mrs. Giesser made a motion to adopt the changes to Rule VII, amended new section 9. Mr. <br />Hohmann seconded the motion and unanimously passed. <br />Mrs. Giesser discussed Rule VIII. A general discussion followed concerning five (5) or less than <br />five (5) certified names on the eligible list and retesting. Mr. Ubaldi suggested clarifying what a <br />single instant certification means. The suggested language would be vacancies for positions under <br />the Appointing Authority occurring before the completion of an appointment process at the same <br />class of position shall not initiate a separate appointment process. Mr. Ubaldi discussed a case <br />scenario concerning the selection process, a selected candidate, a candidate passed over, another <br />vacancy occurs, and five (5) names requested by the Appointing Authority. Mrs. Giesser indicated <br />that she agrees that there has to be some way that they can make two (2) or more appointments at <br />the same time and is not sure on how to accomplish this task. Mrs. Giesser asked Mr. Ubaldi if he <br />would prepare a draft for Rule VIII and forward copies to the Commission before the next meeting. <br />A general discussion followed concerning the eligible list, disqualification, personality conflicts, <br />whole list rejected, and dual openings. Mr. Ubaldi would like to determine what initiates the <br />appointing process and when you have a multiple opening before the appointing process begins. <br />Mr. O'Malley indicated the request of the Appointing Authority initiates this process and you have <br />to keep reminding them of their role because Appointing Authorities come and go. The Appointing <br />Authority would be, for example for the Fire Department, would be the Safety Director. The Fire <br />Department should be communicating to the Appointing Authority informing him of an opening(s) <br />and requesting additional names. Mr. Ubaldi indicated that no additional vacancies can be addressed <br />with an appointment process until one is complete. Under this system, the Commission would <br />ensure that they would have no deviation from ensuring that there are five candidates for every one <br />opening. When you have additional vacancies you start to run into the balance of the first certified <br />candidates and then the additional one(s). A general discussion followed concerning a rule of five <br />(5) certified or a rule of ten (10) certified, and cost efficient. Mr. Ubaldi pointed out that Chief <br />Ruple may have indicated that a rule of five (5) candidates is sufficient and might be burdened by <br />more. Mrs. Giesser pointed out some concerns for Rule VIII. The Rule discusses disciplinary <br />hearings and three (3) Commission members should be present. There is a time factor involved and <br />a possibility of not having three (3) Commissioners at that time. <br />V. NEW BUSINESS: <br />Review of Rules, including but not limited to Rules X through XIV and the Appendix <br />Mrs. Giesser inquired if Rule X through XIV and the appendix will be discussed at this meeting. <br />The Commission agreed to table these rules until the next meeting. Mr. O'Malley suggested <br />circulate some of the changes on the rule changes before the next meeting. Mrs. Giesser inquired <br />beyond Rule VIII and X through XIV is there anything else that will need to be discussed. Mr. <br />Ubaldi indicated that this will be a forever work in progress but as far as major refit this should be <br />fine. Mrs. Giesser inquired to Mrs. Eccleston if Cheryl Farver was able to review the records <br />retention rules and Mrs. Eccleston responded Cheryl Farver will review this and get back to the <br />Commission. Mr. O'Malley indicated that there is a Records Commission of the City of North <br />Olmsted and there are State laws on record retention policies. The Civil Service Rules will be <br />subject to the State laws on records retention policies adopted by the records commission. There <br />are forms for the Records Retention policies that may be appropriate for the commission to have the <br />records retention policy submitted to the Records Commission and then can be adopted. Mr. <br />O'Malley will look into this matter. Mr. O'Malley indicated that any type of records review <br />whether it is under the States records laws and its Records Commission or whether it's under the <br />Civil Service Rules has to start with the Civil Service understanding in inventory of what records <br />
