be selected by the Appointing Authority and in accordance with the Civil <br />Service laws. <br />d. Provisional employees appointed and having performed work covered by a <br />collective bargaining agreement for a time period of twelve (12) months or a <br />period of time exceeding that time period listed as the probationary period for <br />the position within the respective collective bargaining agreement, whichever is <br />a lesser period of time shall not be required to undergo competitive testing. <br />Under the conditions of this provision, the individual is considered a permanent <br />appointee. <br />e. The period of time under consideration shall be time elapsed from the initial date <br />of the provisionaf employment to the validation of an applicable eligible list. <br />f. Disciplinary action taken against a provisional appointee including, but not <br />limited to, discharge and/or suspension, shall not be a subject of appeal to the <br />Commission. <br />Section 4: Commission Notification of Appointment: <br />The Appointing Authority shall immediately notify the Commission of any <br />emergency, provisional, temporary or exceptional appointment. <br />Section 5: Information to Be Provided to Appointees: <br />The Appointing Authority shall provide each temporary and provisional appointee <br />with a written job description for the position to which he/she has been hired and a <br />copy of the Civil Service`rules concerning his/tier eligibility and requirements for <br />future certification to the Appointing Authority for a permanent appointment. <br />Section 6: Appointee Acknowledgment Statement: <br />For each temporary, provisional or exceptional appointment made, the Appointing <br />Authority shall submit to the Civil Service, within ten (10) days of the appointment, <br />a statement signed by the appointee acknowledging that he/she has been informed of <br />his/her Civil Service classification and has been provided with a copy of the Civil <br />Service Rules "and 'Regulations concerning temporary and exceptional appointments. <br />Mrs. Giesser made a motion to adopt the changes to Rule IX. Mr. Ubaldi seconded the <br />motion and unanimously approved. <br />Mr. O'Malley's draft proposal and amendment for Rule VII and VIII <br />Mrs. Giesser discussed Mr. O'Malley's rule.,.change.for Rule VII amended new section 9. Mr. <br />Ubaldi pointed out in review of the rules, there are no specific guide lines has to how the <br />Commission wishes to certify additional names. Mr. Ubaldi suggested amend the last sentence of <br />the proposed rule change. A general discussion followed with concerns of revising, cross reference, <br />or deleting the last sentence. Mr. Hohmann suggested keeping the language as it is. The rule will <br />read as follows: <br />Section 9: Any time that a candidate on an eligible list notifies the Commission, in writing, of <br />the withdrawal of his/her. application' or. candidacy for employment, for reasons <br />either disclosed or per'sonaT, the Commission may consider and act upon such request <br />at its next meeting by removing such name from the eligible list. <br />
