of the appointee's probationary service if he/she is subsequently <br />appointed to a permanent position. <br />2. In the event an eligible list is not available, the Commission may request <br />the Appointing Authority to fill a vacant position with a qualified <br />individual. <br />3. Appointments may be authorized by the Commission, except in the case <br />of sworn Police and Fire Department personnel, upon the written request <br />the Appointing Authority who shall set forth in full any reasons for the <br />request. <br />d. Exceptional: Where there is a vacancy in a position in the classified service <br />where peculiar and exceptional qualifications of scientific, managerial, <br />professional or educational character are required, and competition in such <br />special case would be impractical, the Appointing Authority may fill that <br />position with a designated person of commensurate qualities. Appointments may <br />be authorized by the Commission, except in the case of sworn Police and Fire <br />Department personnel, upon the written request the Appointing Authority who <br />shall set forth in full any reasons for the request. <br />Section 3: Provisional Employee Testing Criteria: <br />Provisional employees appointed to a position determined to be testable by the <br />Commission shall be subject to the following criteria: <br />a. Provisional employees performing work not covered by a collective bargaining <br />agreement and having performed non -bargaining unit work as a provisional <br />employee less than twelve (12) months prior to the date of the examination, shall <br />be subject to successfully passing a competitive examination and compete with <br />other applicants for a ranked position on the eligible list. Such an appointee <br />shall not receive a permanent appointment unless he/she ranks with other <br />applicant and is certified by the Commission and selected by the Appointing <br />Authority in accordance with the Civil Service laws and these rules. Applicants <br />i..1 .. <br />that fail to rank sufficiently high enough or are not selected by the Appointing <br />Authority or fail to pass any component of the required competitive test shall be <br />removed and the provisional appointment revoked. <br />b. Provisional employees performing work covered by a collective bargaining <br />agreement who were appointed and having performed work covered by a <br />collective bargaining agreement, for a time period less than twelve (12) months <br />-or a time period equal to one-half (1/2) of time period listed within the respective <br />union contract. as he,_probationary period for the position whichever is a lesser <br />period of time, shall be subject to successfully passing a competitive <br />examination and competing with other applicants for a ranked position on the <br />eligible list. Such an appointee shall not receive a permanent appointment <br />unless he/she ranks with other applicant, and is certified by the commission and <br />selected by the Appointing Authority in accordance with the Civil Service laws. <br />c. Provisional employees appointed and having performed. work covered by a <br />collective bargaining agreement for a time period which exceeds one-half (1/2) <br />of their` probationary period; but have not completed their entire probationary <br />period listed with the respective union contract, shall be required to simply pass <br />a competitive examination if such examination is given.
