a. Reduction or suspension of more than three days: In any case of a reduction or suspension <br />for more than three (3) days, the appointing authority shall serve the employee with a <br />written order of reduction or suspension. <br />1. Such order shall state the reasons thereof. <br />2. A copy of such order shall be filed with the Commission within three (3) days of <br />service of the order on the employee. <br />3. Such order shall contain a statement advising the employee of the right of appeal. <br />4. Such order may be appealed by the employee. <br />b. Suspension of three days or less: In any case of a suspension of three (3) days or less, the <br />appointing authority shall serve the employee with a written order of suspension. <br />1. Such order shall state the reasons thereof, and the number of prior disciplinary actions <br />received by the employee within the last twenty-four (24) months. <br />2. A copy of such order shall be filed with the Commission within three (3) days of the <br />service of the order on the employee. <br />3. A second or subsequent suspension of less than three (3) days within a twenty-four (24) <br />month period may, at the discretion of the Commission, be appealed by the employee. <br />Section 5: Removal Procedure: <br />a. The appointing authority shall serve the employee with a written order of removal. <br />b. Such order shall be justified by one or more statutory causes, or sufficient non -statutory <br />cause accompanied by sufficient factual evidence. <br />c. Such order shall contain a statement advising the employee of the right of appeal. <br />d. Such order may be appealed by the employee. <br />e. A copy of such order of removal shall be field by the appointing authority with the <br />Commission within three (3) days of the service of the order on the employee. <br />f. An employee's removal shall become effective upon the appointing authority's <br />compliance with all procedures as enumerated in this section. <br />Section 6: Appeal Procedures: <br />a. Reduction or suspension of more than three (3) days: Within ten (10) days after the filing <br />of the disciplinary order by the appointing authority with the Commission, the employee <br />may file an appeal with the Commission. <br />1. The appeal shall be in writing and shall contain the reason or reasons as to why the <br />disciplinary action should be reduced or rescinded. <br />2. The commission may, at its discretion, grant or deny the employee a hearing. <br />
