I. <br />II <br />IV <br />CITY OF NORTH OLMSTED <br />CIVIL SERVICE COMMISSION MEETING o <br />CITY COUNCIL CAUCUS ROOM <br />MINUTES - OCTOBER 15, 2007,\� <br />7:00 P.M. <br />ROLL CALL: Chairman M. Ubaldi called the meeting to order at 6:56 p.m. <br />PRESENT: M. Ubaldi, W. Hohmann, and K. Zolar <br />ALSO PRESENT: Sandie Agresta, Lori Borowski, Thomas Herbster, Assistant Law Director B. <br />O'Malley, Civil Service Secretary D. Eccleston <br />DISPOSITION OF MINUTES: <br />The Civil Service minutes dated September 17, 2007 and October 1, 2007 have been submitted for <br />approval. <br />Mr. Ubaldi made a motion to accept the minutes as submitted. Mr. Hohmann seconded the <br />motion and unanimously approved. <br />COMMUNICATIONS: <br />There were 10 items of correspondence received and 32 items of correspondence sent out by the <br />Civil Service Commission. <br />A memo dated October 9, 2007 from the Public Service Director regarding the lay off rationale <br />statement for the Secretary II at the Waste Water Treatment Plant was submitted to the Commission <br />and will be included in the New Business section. <br />CI]"1A: IMMIRI <br />Review the Draft Rules & Regulations from the Law Department <br />There were some issues raised by the Safety Director at a prior meeting and the Chairman has <br />comments as well. <br />Review the Rules and Regulations <br />A discussion commenced concerning the Preamble, page vii, Chapter 2, Section 2b, 5: "In the <br />absence of the Chairman, the Co -Chairman shall act as a Chairman with two members of the <br />Commission constituting a quorum, except for disciplinary hearing, where all 3 members must be <br />present. An affirmative vote of at least two (2) members shall be required for the adoption of any <br />resolution or motion ". At the beginning of the month, the Commission was set to conduct a hearing <br />and had two (2) Commissioners present and felt that they were well equipped to handle the hearing. <br />A general discussion followed concerning what a disciplinary hearing would entail; lay off. This <br />introductory provision is not often used but can be used occasionally and requires an affirmative <br />vote by two (2) members; therefore, a recommendation was made to keep the current language. <br />Procedurally, the appointing authority makes a determination on discipline whether it is a <br />suspension or removal and then the appeal comes to the Commission and the Commission's <br />
